He said again the Authorities can take away your rights to firearms during a declared State of Emergency. Like they did in New Orleans During Katrina. The case went before the Supreme Court and they ruled that the Police Department violated the people of New Orleans right to keep and Bear Arms

Yes, all that was done here during the double hurricane hit we took in 2004 except the last 2, (transport, and removal of a firearm from your residence)

In North Carolina, a mayor of ANY MUNICIPALITY can declare a curfew during a state of emergency, and legally prevent the sale, transport, and removal of a firearm from your residence. I am not saying it's constitutional, I'm saying it has been done in N.C. recently, and the police will charge you with a class three misdomeaner if caught.

After the show with Stewart, The internet lit up with articles and comments all over the place discussing Bill O'Reilly's comments supporting gun confiscation during Hurricane Katrina as well as the Oath Keepers organization in general. One of the most active discussions was over at Sean Hannity's message board.

We also came across the Gateway Pundits which in a short article titled, Bill O'Reilly Supports Gun Confiscation During Weather Emergencies, the author made a great statement saying, "Last I checked, the Second Amendment doesn't mention anything about severe storms." included in the article was a statement made from the Instapundit adding:

That's funny. O'Reilly calls the opposing position "extreme," but such gun confiscation is illegal under federal statute, and as a matter of constitutional law; in fact, the city of New Orleans lost a lawsuit over gun confiscation during Katrina. But then, O'Reilly's no libertarian, to put things mildly. And he's consistently weak on the law, also to put things mildly. Still, he should have been better briefed for this show, as he came across looking like a fool, and making his "extreme" guest look sober and well-informed by comparison.

We took care of this problem here in KY:

237.104 Rights to acquire, carry, and use deadly weapons not to be impaired
during disaster or emergency -- Seizure of deadly weapons during disaster or
emergency prohibited -- Application of section.
(1) No person, unit of government, or governmental organization shall, during a period
of disaster or emergency as specified in KRS Chapter 39A or at any other time,
have the right to revoke, suspend, limit the use of, or otherwise impair the validity
of the right of any person to purchase, transfer, loan, own, possess, carry, or use a
firearm, firearm part, ammunition, ammunition component, or any deadly weapon
or dangerous instrument.
(2) No person, unit of government, or governmental organization shall, during a period
of disaster or emergency as specified in KRS Chapter 39A or at any other time,
take, seize, confiscate, or impound a firearm, firearm part, ammunition, ammunition
component, or any deadly weapon or dangerous instrument from any person.
(3) The provisions of this section shall not apply to the taking of an item specified in
subsection (1) or (2) of this section from a person who is:
(a) Forbidden to possess a firearm pursuant to KRS 527.040;
(b) Forbidden to possess a firearm pursuant to federal law;
(c) Violating KRS 527.020;
(d) In possession of a stolen firearm;
(e) Using a firearm in the commission of a separate criminal offense; or
(f) Using a firearm or other weapon in the commission of an offense under KRS
Chapter 150.

I don't know about the rest of you but, I'm sick and tired of every idiot (in print, radio, and TV) babbling about when and how our RIGHTS should be ignored or suspended. These people and their ilk clearly do NOT have a clue WHY the founders spelled out, in plain language, what the government was FORBIDDEN to meddle with.

Ask one of these twits the reasoning behind the amendments contained in the Bill of Rights and their eyes glaze over and the grass gets greener in the area.

Occasionally I watch O'Reilly just to see if any of his guests are allowed to complete a sentence before he interrupts and tells them how he sees things. It's really quite amusing.

I remember watching him have a conversation with the doctor who came up with the South Beach Diet. Nearly the whole time O'Reilly told the good doctor how he had a tuna sandwich for lunch with a few chips. Never did learn what the South Beach Diet was until I read reviews of the book and finally purchased it.

Part of what I love about O'Reilly is how he calls people who won't appear on his show cowards. Heck, they know they won't get to say anythng and they'll just be told how wrong, wrong, wrong they are.

He was really in top form Friday night (didn't see the original show on Katrina) when he defended his Katrina position by pointing out that Lincoln suspended habeas corpus.
 
I never could figure out why I need O'reilly to "look out for you me)"..I'm an adult and am perfectly capable of looking out for myself and my family..why do I need a sycophant like O'reilly to tell me what I need think about or give a rats *ss about.

I'm beginning to think he's a rumor in his own mind.

Last night Bill tried to defend his position on the state of emergency gun confiscations by saying it was a court issue and to change it we'd have to take it up with the Supreme Court. The very next breath, Bill complained about the court decision that the 17-year old dancer was art and how reprehensible that court decision is. He wants it both ways - it's a court decision which can only be addressed through the legal system when he agrees and the judges are crazy and must be accosted on the street when he doesn't.

Meanwhile, the rest of the entire hour show was a tabloid on Tiger Woods.

Sorry, Bill. It's over between us. I won't be watching anymore.
