I am not one for twisted logic, but I am really peeved when I hear people advocate that victims of a shooting should be able to sue the firearms' manufacturer. I was really upset when a judge granted the families of the victims of Sandy Hook the right to file suit against Bushmaster. I strongly believe that the manufacturer can not be held responsible for how the end user uses their products.

That being said, and the fact that the precedent has been set where the survivors of Sandy Hook were permitted to sue Bushmaster, I believe that I should be able to sue General Motors for building the Cadillac that an errant motorist used to hit me and leave me disabled.

Would anyone have any comments about my idea of a parallel liability suit?

I am in full agreement with the first part of your post.

And while I am terribly sorry to hear of your disability due to some miscreant's misuse of an automobile, I don't think the manufacturer should bear any responsibility unless something wrong with the vehicle, (faulty brakes as installed by the manufacturer, etc), was at the heart of the issue.
 
I think most people will agree that manufacturers should not be held responsible for misuse. However, if this is the precedent, then I should be able to sue the alcohol manufacturer and car manufacturer for the drunk driver who hit me. I would never do that, but just throwing that situation out there. :D

A State judge allowed the attorneys for the family to sue, however they will lose the case because Federal Law preempts this theory of "product liability".

It is a political football in CT, and this judge is playing ball. Unfortunately a lot of money will be spent before this is all resolved.
 
The families were allowed to file a lawsuit against the movie theater owners in the Aurora theater shootings and they lost.This was a jury trial and it got turned down by jurors who probably even knew some of the victims.

People who are grieving are too easily misled by lawyers looking to make a name for themselves or a quick buck.
 
Wise old sayings...

Wise old sayings don't consider that the goose and gander may be in entirely different positions and that generally stating what is good for one is good for the other is overly simplistic.
 
I think the original saying is
"What's sauce for the goose is sauce for the gander."

Meaning that if you apply some rule, moral code, whatever, to others, you must apply it to yourself as well.

It is not meant as advice to ensure the well being of poultry.

Objects like guns and cars do not have a mind and soul to think with. It's all the user, but I'm preaching to the choir here.

What peeves me is cars, swimming pools and steak knifes all kill people also (used to kill people). But these items are all used or are useful to those who are afraid of guns, therefore, guns are evil and the others get a pass.

IMHO Those who were affected by the SH shootings have a need to lash out and blame somebody/something and they will not get satisfaction from the shooter, therefore the gun maker gets it.
