I believe that ruling is correct. It will be appealed, guaranteed, and the SCOTUS will then have to decide to either let the 6th Circuit's ruling stand or hear the case and make a final decision. Time to make some popcorn.
 
I’ll bet it’s a lot more than 3 were turned in or destroyed. I wonder if people who turned them in have any recourse for compensation or recovery. :rolleyes:

Too bad, that's what you get if you're stupid enough to comply with any unconstitutional ruling. Sucka! lol
 
I'm not sure Garland would take this further. Say there's an en banc and it's reversed. This would likely require a finding that Chevron applies to criminal statutes. And say what your want about the liberal wing of the Supreme Court, I don't see the remaining solid three expanding Chevron to criminal statutes as attempted here, followed by two more justices.

I think the bump stock ban is kaput for now, and until actual legislation and not agency rules are passed.
