Handgun transfer information
OK...So I want to give my wife's son a handgun. I am an Illinois resident and will be driving to Florida where he lives and I will be bringing it with me. Do I have to transfer through a FFL, or just face to face. Thanks ahead of time for any information.

If you are bringing it with you, won't you both be in FL? Is it illegal to give a firearm to a family member? I guess I don't know either, but it wouldn't keep me from giving a family member a gift.

Supposed to go through an FFL,,it's a interstate transfer.
Family, gift and both standing in the State of FL has nothing to do with it.
The persons involved in the transfer are legal residents of 2 different states.
But people do what people do.

Simple answer for most citizen's of the US, except for Illinois, you can transport an unloaded handgun, either in the trunk of your car or in a locked carrying case. The ammunition can not be with the gun.
I assume that it is registered in your name in IL and have an FOID to transport while in your state? As for giving it to your wife's son, let us just suppose it is stolen in Florida and used in a crime. Who do you think they will come and visit first?
As I understand it, there are no handgun registration laws in Florida, but I would make sure to contact the IL authorities to let them know that you are disposing of the handgun. They will tell you how you should proceed with the transaction and how to de-list you as the owner.
Personally, I would err on the conservative side, especially in Illinois. With today's anti-gun paranoia, you can really get jammed up.

With the exception of Chicago there is no gun registration requirement in Illinois. The FOID card allows the holder to purchase a firearm but the gun itself is not reported to or registered with the State.

Carry the gun legally to Florida. Have a Florida FFL do the transfer to your son in Florida. No federal law prevents your carrying a legal gun across state lines.
