I don't mean this to be a political thread.
I don't mean this to be a pro or anti MMJ thread.

I understand the line on the 4473 form about illegal use of drugs. I understand the fed has notified FFL dealers something or other regarding sales of firearms to MMJ card holders being illegal. But

what about weapons owned prior to acquisition of the MMJ card?
what about weapons bought FTF?
is it a federal crime for a MMJ card holder to own ANY firearms or is this only regarding FFL sales? Pretty confusing.
Not a cardholder OR user so it's not a personal issue, just one of those random things that caught my interest.
 
I'm just going to sit on the sidelines with a bag of Doritos instead of popcorn. :)

It's not all that confusing. You can't possess a firearm if you are an illegal user of a controlled substance. From your post, the feds have already made clear that you can't purchase a firearm with a MMJ card, and possession of a firearm is in the same sentence in 18 USC 922 (g). Short answer is it's illegal on the federal level, so I expect somebody to indict somebody in the near future.

I can answer this without even mentioning the word ********. What's the difference between mmj and pain pills or any other drug that can impair? If you are impaired don't operate heavy machinery or drive.

If mmj is an excuse to restrict guns why not:

Cold remedies?

Allergy meds?

sleeping pills?

Codeine containing drugs?

As mentioned before, pain meds?

PRESCRIBED mmj is not an illegal drug.



The pro gun control people can take out about half (or more) of the gun owners in the US with this kind of legislation.

I expect somebody to indict somebody in the near future.

Prosecutor's case will rest on federal law while defense will say its legal in the defendant's state, and will bring up the feds letting that ride, including active federal measures to allow it, for example telling banks recently that it was OK to let maryjane businesses in states that have legalized it that they could let those businesses have accounts without running afoul of banking laws and the FDIC.

The result? Depends on the jury...when they find a defendant willing to take his chances with a jury rather than plea out to a greatly reduced charge.

Prescribed MMJ IS an illegal drug in the feds eyes. The others are not, if taken as prescribed.
 
so it's legal when you want it to be legal. And it's illegal when you want it to be illegal. And it's somewhere in the middle when your not sure what your position should be in case the polls change? Makes perfect sense. (if your a politician)

That is an incorrect interpretation of the battle between state and federal rights that has been ongoing since 1789 . . .
 
The medical marijuana excuse is just a back door way of legalizing it for the anyone's use. It is still a Federal crime in states that have legalized it, like Colorado. I think this will take a while to play out.

Also, how does this play with major league teams drug policy when teams go to states where it is "legal" and partake, then fail the drug test?
