I can only wish that these tragedies not rely upon a prosecutor losing patience. I would hope that our laws were applied equally in every situation, regardless of who is involved.

I will continue wishing and hoping, but the revolving door at the courthouse will keep going around and around (and not just for drunk drivers or any other category of miscreant).
 
There was a story in the paper this morning where a local San Antonio guy killed some woman as a result of a DUI incident in 2017, and just got an 18 year prison sentence for intoxication manslaughter and manslaughter. I didn't read much beyond the headline, so I don't know the details. I imagine he probably had a long DUI/drug abuse history.

Those 2 jerks wouldn't want me to be a juror in either of their cases. It's just too bad you can't hand out the same judgement on those 2 yahoos that they gave those people involved in their wrecks. Because I think it's a waste of oxygen every time people like those take a breath.
 
Last year in Reno; a man who was convicted of his third DUI, plus hit & run, plus injury to the other motorist got 20 years.



August 2017 in Gardnerville, a man with his second DUI conviction got 5 years in State prison with eligibility for parole after 3 years.



DUIs in Nevada are taken very seriously.
 
Now more and more states, including mine soon, are legalizing marijuana. What could possibly go wrong???

Poly-substance DUIs are WAY up. The crime lab is backed up several months on blood testing (it was always grossly understaffed and their pay was abysmal last time I knew), when we need all results for all tests in 2 weeks or less. The regulatory scheme that is supposed to keep everything on the up and up is a farce, and the people who are supposed to be leading the compliance efforts are simply not funded to do their work and cannot get the resources they need for enforcement.

The regulatory entity will issue licenses with no consideration for local zoning and prevailed in court for no reason why can understand, so we end up with licensees opening up and then having to do code enforcement on them. That wastes the local government's money and time, the licensees' time and money, and makes us all mad.

Our DUI laws are still weak, but not as bad as they were a decade ago.
 
Marijuana provides one more tax teat for the government to suck on.

The news here in Colorado reports month after month that they are pulling in 100 million dollars a month on weed taxes. Colorado surpasses $1 billion in marijuana tax revenue No way anything will stop that ball from rolling. And the wonderful Democrat government here makes such good use of the funds for the people. You can tell by the overwhelming homeless situation, failing school system, terrible roads and traffic proems, etc.etc... Of course, being a sanctuary state and all, the illegal aliens here get to live pretty comfortable on welfare.
 
Happens all the time down here. The Vehicular Homicide law carries 5-30 years and the DA's are not shy about using it. Defended a guy just last year-convicted him of taking out a motorcycle rider-he got 25 years. Unless you can prove that being under the influence had no effect whatsoever in causing the accident, you are gonna get convicted. It ain't pretty-two families destroyed by one stupid decision. Perhaps the most stressful homicide a defense lawyer can be involved in ad you usually have the defendant's family breathing all over you about what a good guy he is, etc. I've done three or four over the years and Hope I never have to do another one again.

Hahahhaaa!!! Reminds me of the arguments made for legalizing gambling here about 30 years ago. Look how much money it will bring in for the schools, etc.

Florida has long given some very long prison time for DUI manslaughter but just like gun laws it will never stop them all. Just last week a guy with a suspended license and DUI ran a red light and killed a grandfather and his two young grand children.
 
Sad because it is a 100% preventable crime.

We are discussing humans and specifically bottom feeders. If they wanna get drunk or high, they will find a way no matter what law or punishment you impose.
There is no 100% sure way to prevent any bad behavior by a human.

I don't like drunk drivers either, but is murder an appropriate charge? The prosecutor is claiming that he intentionally killed someone? I guess I'm not ready to say that killing someone while driving drunk is on the same level of evil.
