Yes it's legal, it's a brace not a stock. The gun is still classified as a pistol.

That would be very easy to do. But i wonder if S&W has a patent or copyright on the design of the lower? I know its slightly different spec than a regular AR lower. I'm reminded of Pro Mag getting sued by S&W for the magazines they were making. Its something to look into though.
