922(r)BATFE regulation

I posted this in another forum, but I would like to get as large an audience as possible:
Anyone ever had a cop or game warden check their Saiga AK for 922(r)BATFE regulation? It seems to me like a really stupid law. They can't expect all Saiga conversion owners to carry all their old receipts showing where the parts originated. How would they ever be able to check? Some enlightenment would be appreciated.

I've never heard of it happening. If they were after you for some reason it might come into play.

The penalties are for assembly, not possession, which might be a bit of a problem to prove who assembled what, though the weapon itself would be forfeit. Anyway, all the U.S. made conversion parts necessary should have "USA" or something along these lines stamped on them to indicate country of origin.

I'm not sure if there is any case law related to whether or not a search warrant would be needed to disassemble someone's rifle and examine it.

I try to fly low, real damn low under the radar. My main concern is shooting at the public range, or when I finally get to go hog hunting, since those are the only two situations I forsee myself using the rifle. If I have to use it to defend myself, 922(r) will be the least of my concerns :eek:
 
I have still never found a prosecution of a 922R violation--
not saying it never happened---anyone got proof? Pete
 
I would assure that the gun DOES have the required parts...but ACTUALLY having an ATF Agent or other LEO that knows enought about the law to check...THAT would be a VERY rare situation.

Similar to the idiotic magazine capacity law back in the Clinton years. I looked and looked but never found a single case of Joe citizen being actually prosecuted over having a then illegal hi cap...UNLESS Joe Citizen had taken a turn to crime...THEN I did see a few charged with the hi cap violation...but always due to another violation.

So if your rifle is compliant, why do you "try to fly real damn low under the radar"? I would gather from your comments that your rifle is NOT compliant. In my jurisdiction, it depends on the officer you come in contact with. Not all are well versed on firearms regulations. I on the other hand, check everything. If I were to catch you with it, I'd push it as far as i could. Why? Because people that try to work around the law cheapen the efforts of the law abiding and give the anti gunners more ammo. By the way, my agency maintains liason deputies with the FBI and the BATFE. We also have deputies that are sworn federally.

I think your question would be more appropriately asked at ar15 or the xcr forum, both places which have a little less respect for law enforcement.

So every time you see someone with a post ban AK you confiscate it and break it down?:rolleyes:

I'll assume you're also one of the guys who run citizens guns too.

Do you also carefully inspect every vehicle to assure they didn't possibly remove some sort of emission device?

I've actually removed the DO NOT REMOVE UNDER PENALTY OF LAW tags from my matresses and box springs.:D

First of all, the rifle has never been fired, so at what point during the modification does the rifle go from legal to illegal back to legal again? Technically, I could be in violation mid-conversion since the rifle could fire a single round (without the mag inserted) but not have all the US made accessories installed. I guess you'd be happy to arrest anyone while they are in the process of doing the conversion. Glad to see you are part of the "police state".

Secondly, I try to fly real damn low under the radar because of police like yourself. I was arrested once for an empty sandwich baggie (bread crumbs and all). I was charged with marijuana possession and paraphernalia (I don't do drugs) and I spent the night in jail. The judge thew the case out and made the cop look like an idiot in front of the court. I still had to pay my attorney $1000 plus about $300 court costs. So yes, I avoid police and have little use for them.

They usually don't pursue prosecution for those offenses.
Pillow tags are an entirely different matter!
We have a few people in Georgia doing Life Without Parole for pillow tags.
I believe Texas executes for it, but I'm not certain, so I'd suggest:
Check the Texas penal code,
OR
Stay out of Texas,
OR
Don't mess with pillow tags in Texas.
