A question for folks in California:

How would you sell/ship a rifle to another state? I am watching an auction by a private individual for a Californina legal semi auto rifle. Do you have to take the rifle to a FFL dealer and have him ship it? In Montana I would just take it to the Post Office and mail it to the FFL holder after receiving the payment and paper/faxed/emailed copy of the FFL. Would a $100 fee, including shipping be normal?

Thanks in advance

California requires all transactions to go through a FFL. Federal law requires the same for interstate sales. Laws for both states have to be complied with. Here is the relevent federal law.

922(a)(3) It is a crime for any person, except a person licensed to deal in firearms to transport into or receive in the state where he resides any firearm purchased or otherwise obtained by him in a state other than his state of residence unless done so in compliance with the legal conditions governing transfer, sale, delivery and receipt in both states.

922(a)(5)It is illegal for a person, other than a person licensed to deal in firearms to transfer, sell, trade, give, transport, or deliver any firearm to any person, other than a licensee, who resides in any state other than that in which the transferor resides.

Thanks for the reply. I see a lot of listings that will not make sales to California. I understand that there will be service charges to a citizen in California for State and FFL dealer fees to make a sale. And, these charges could add an extra $35, or more, to a sale. Even between individuals in California.

To sell a gun to another indiviual in CA in a FTF transaction it must go through a dealer who must charge a $25 fee, which goes to the state. They may charge an additional fee up to $10, no more, to cover their expenses. If you ship a gun to them from inside or outside the state, the shipper must first get an shipping number from the state Department of Justice. If the gun is a handgun and is comming in from out of state it must be on the Roster of Approved Handguns, unless the handgun is a SA revolver or the person purchasing the handgun is LE. The Dealer still must charge the $25 fee and can charge whatever they want to receive the gun for you.
