Can our government agencies get anything right ? Just got a "DENIED" backround check

Here I go again !!! If any of you remember my saga from a few years ago, you know what I'm going through...AGAIN !!! I am a registered concealed carry pistol permit holder in New York. It takes a fairly clean backround to go through the lengthy and somewhat expensive process of obtaining a permit to own a handgun in our wonderful state of New York. A couple of years ago after owning, buying, and selling and trading some handguns for a few years, I was told I was denied on a handgun purchase by my FBI backround check. Apparently the way New York State gun laws were written I was disqualified on a long gun purchase but was okay on a handgun purchase, yeah, go figure. So the feds figure that they will interpret the laws of New York differently than how they were written and deny ownership of a handgun to me. They tell me I should have never been issued a permit !!! Okay, so which way is it gonna be ??? Are you coming to take everything I have or what ? Anyways, I have to appeal the backround check decision and also have my lawyer obtain what is called a "Certificate of Release from Civil Disabilities" from the court where I was charged with endangerment of a minor when I was one month into my 19th birthday (Note: Do not serve beer to minors in a State Park, or anywhere else for that matter). No problem there, got all my paperwork done, got my certificate, sent everything in to the appeal process. Everything was a GO and I was once again able to purchase both long guns and handguns. Been about 3 years now. You guessed it, today I was "DENIED" !!! Can't these people get this crap straightened out ??? I had asked and never received a "Personal ID #" from the FBI so I would never have to go through this again. I am so freakin' frustrated...... Now what do I do ????????????? Ugh.....Shoo

I have beady eyes, a receeding hairline, and 9 1/2 fingers, does that count ??? LOL ! Maybe I got denied because I was just gonna buy a little 22lr semi-auto for plinkin', had a Phoenix Arms picked out. My buddy was gonna throw in the optional extended target barrel and extra mag that usually retailed for $109, for $25. Grand total for gun and kit was $124. Maybe they denied me for my taste in guns.... Shoo
 
Shoo, I can offer only one piece of advice to your dilemma -MOVE.

I hear ya.....I've thought about it.......shouldn't have to though. When are Americans finally just say enough to all this crap ? Who decided to give the states the right to modify, change, deny, or interpret differently the laws and rights granted by the Constitution ??? I should have a federal carry permit and should be able to carry my licensed pistol anywhere I want, in any state !!! It's crazy !!! Shoo
 
Maybe it was because you have only 9 1/2 finger prints instead of the ten on file :D . Sorry - I just had to say it. Hope it works out faster than the last time.
 
Bureauocracy hard at work justifying their existance. Making you spend money running around in circles trying to correct their ineptitude.:mad:
 
i get delayed every gun i buy, they always call back and ok it the next working day, looks like they would catch on at some point! our tax $ at work! and if i was at a gun show or out of town it would kill the deal for me, but that must be just what they want?

Sounds like you're feeling better .... That's good to see.
I've had trouble when doing the FBI background checks because I don't have any fingerprints. I've had to have one for my permit of course, one for my Florida permit ..... that was a real treat ..... and one for my class A cdl w/ hazmat. Got fingerprinted 7 times for that one. You'd think they would be able to figure you're not a threat if you keep showing up at the State Police barracks.
 
In Texas, your carry permit takes the place of a NICS check so it doesn't need to be called in. One thing I can assure you is if you get denied once, even after you get this situation straightened out, you will be denied again. You need to get the UPI number so you can avoid that from happening.

Soon after I began active duty, I came to know a simple logic. For any task, there is the right way to do it, the wrong way to do it, and then, there is the Government way to do it....

They won't care about you anymore once you are on the government nickel. You'll be taken care of as long as they are bleeding you dry of your hard earned paycheck. Once you can't pay taxes anymore then they won't have any use for you. Like telling women they don't really need breast exams until the age of 50, yada, yada, yada...... Let's re-do the food pyramid again...... guns kill people..... and on and on......
 
You just never know when dealing with government. Years ago I had a NICS person get totally confused over the paperwork I was required to submit as a non-immigrant alien. She could not get it round her head that legal residency of a state IS NOT the same as residency of the US. Long story short, I got my gun while everybody else involved claimed they did not need the copies of the relevant paperwork I had made up for them. So much for trying to help.:rolleyes:

When my wife and I went to get our marriage licence, I took my passport and UK birth certificate as you might expect. At the counter I produced all this stuff whereupon the lady gave me the "It's been a long day" look and asked, "Do you have any local ID?" I replied that I had a local driving licence. "Good, that's all I want to see", she said. Legal? Who knows, but both of us went home happy.:cool:
 
Okay, today is a better day. A NICS supervisor called my FFL and told them they had denied me in error. I now have a "proceed". Guess that maybe things aren't as screwed up as I thought. I'm off to pick up the little Phoenix Arms .22 and to put a Star Starfire on layaway. Thanks for listening to me whine.....Shoo
 
Shoo since this keeps coming up-you may wish to check into getting an expungement. Don't know the laws up there, but in Louisiana as long as certain criteria are met one can get old stuff expunged and the record wiped clean. I do this a LOT for people down here for CCP's TWIC cards etc. The only thing that kills you dead is a domestiv battery conviction. Also if you are arrested but the DA for whatever reason decides not to prosecute, it is ALWAYS a good reason to get the ARREST expunged as it shows up and to a lot of uninformed, an arrest is as bad as a conviction.
 
I worked for one of the local sporting goods stores for several years before we came to a parting of the ways and have seen a number of NICS oddities. My favorite involves a local businessman who was denied on a firearms purchase. He had bought several previously without any problem. The appeals process is done on his end and eventually he gets a letter from NICS. The letter stated that they basically could not determine for sure if he is qualified to purchase or not qualified to purchase, and they were authorizing a one time purchase. The letter further advised that if there was any firearms he wanted, it was advisable to do it then. The gentleman pursued the issue until it was finally straightened out. Turned out he had a brother who either had done or was doing prison time. Except for the family name, the names weren't even close and of course, SSN's were different. For some reason, NICS just couldn't seem to figure it out .
 
I get delayed quite often, shoo, even though as you are aware I have a purchase order signed by a Judge. I guess they don't trust the judges.
