FFL delay

Maybe somebody can shed some light on the subject. I bought a M&P15 online back in July NICS check preformed 7/17 was delayed. Picked up rifle after 3rd business day. I recently ordered a stripped lower receiver went to my FFL guy and told him to expect package. He told me he would not accept because my M&P15 from July is still in delay status. My only conviction is a disorderly person misdemeanor from 3 years ago. I was in the military from 95' to 98' living in multiple cities and put ssn on form. Should this be something to worry about? I read that a delay status is purged from the system after 88 days. Does NICS sometimes never call back? Hope all this information helps. Thanks

That is why you can pick up gun after so many days. It may never come out of delay status. I would find another FFL to deal with. As long as not a deny, you are good to go.
 
Thanks! Yeah, I'm not dealing with him anymore even when I get my cpl. I'll take my business elsewhere. He said he did me a favor by transferring to me because he's known members of my family for many years.
 
In my opinion, the FFL is a moron. Once the three days are up, why should they continue trying to clear you or deny you. It's done.

And anyone that tells you that something they are doing is either immoral, illegal or unethical, but they are doing it, "just for you", because "I've know you so long", is a criminal at heart.

I would also find another dealer.
 
I have been told that the background checking continues for 30 days.. and then is dropped.. After 3 WORKING days.. The FFL MAY transfer the firearm..

It was nerve racking waiting the 3 business days plus the weekend tons of Internet research. I went to pick it up and he asks me if I'm sure I want to take it. Hell yeah I want to take it home. I lost quite a bit of sleep over that lol
 
Your FFL can and should have checked the status of that delay before he transferred the gun to you. If I remember correctly he simply calls NICS and presses 2 instead of 1 and he can ask for a status. I've never heard of a drop status on a delay. I've gotten several calls on delays that were months old. Might be changed now it's been a couple years.
 
Regardless he's losing out on plenty of transfer fees since I'm stocking up on lower receivers and starting my own builds
 
FFL's brain needs a reboot. Either that or he is an idle so and so. Could be he's not that sharp on the laws, too. Some of them aren't. As my immigration status changed over the years, I have owned firearms in the US using just about every weird exception/obscure clause in the firearms laws. As a result, I quickly learned which FFLs were on the case and which were not.
 
You should contact the ATF and find out why you are always delayed.

It may be that you name is similar to a Felon, and that is the only reason. If there is no lawful reason for YOU to be delayed, the ATF will issue you a Unique Identy Number, that the dealer will give to the instant check people, along with your name.

The Delays will stop...
 
It's probably the disorderly misdemeanor I had 3 years ago... As soon as the 3 years are up 10/11/14 I'll be applying for my cpl license then I won't have to wait anymore.

I don't think he is to sharp on the laws.... It says on atf/nics site a delay is purged from the system after 88 days. He disagreed about that.
