Dear Smith and Wesson Forum I live in the state of Illinois and i recently attended a very nice gun show and i have a question about buying a gun at a gunshow how does the whole process work when buying a gun at a gunshow? sincerely and respectfully mg357 a proud member of the Smith and Wesson Forum.

You must abide by Fed, State and local laws.

A buyer is required to show his Firearms Owner’s Identification Card (FOID) when purchasing any firearms or ammunition. Any seller is required to withhold delivery of any handgun for 72 hours, and of any rifle or shotgun for 24 hours, after the buyer and seller reach an agreement to purchase a firearm.

The waiting period does not apply to a buyer who is a dealer, law enforcement officer, or a nonresident at a gun show recognized by the Illinois Department of State Police.

The seller must retain for 10 years a record of the transfer, including a description of the firearm (including serial number), the identity of the buyer, and the buyer’s FOID number.

A federally licensed dealer must contact the Department of State Police for a background check, for which there is a $2.00 fee. Any sales at gun shows, including dealers and private parties, must contact the state police for a background check.


Private parties selling firearms at gun shows must ensure the buyer has a FOID card and the buyer must undergo a background check. It is unlawful to sell or give any handgun to a person under 18, or any firearm to a person who is not eligible to obtain a FOID.

i have been going to gun shows for years and i have never heard
of this card. when i sell gun i get there driver lincense number and
make out a detailed receit.

in new york with handgun deals you need a pistol permit, long guns
are easier as long as it's person to person.

can't do this in new york city....
 
You are going to get added restrictions from state and local laws. Sometimes you get so used to what you have to deal with that you think everyone has to deal with it as well. I live in Florida and while I have the three day wait on a handgun there is no wait on a long gun. And that can be waived if you have a FL CCW permit. But there is no general firearms owner permit card in FL at all. Go up to Georgia and they have their own system that is slightly different. I feel for my family in Nevada that has to deal with it county by count and some of them don’t honor each other. Disturbing.

The very reason I cringe when people start talking about "nationwide" anything regarding licenses, carry, purchasing, etc. I'm glad I live in the Free State of Georgia:D. I don't want the "progressive" states like Illinois, Maryland, etc. to contaminate our backward, hick gun laws. I do feel sorry for gun enthusiasts who have to jump through the hoops as described here just to buy a gun.

+100. I do love that about living here in Georiga. I can just walk in, pick out a gun, pay for it, take it home.
 
The FOID is an Illinois thing.
If you go on a hunting trip to FOIDland, make sure you bring enough ammo to last you through your stay. Without a FOID card you can not buy ammo in IL. We went on a waterfowl hunt southeast of Carbondale, IL in the Crab Orchard WMA area several years ago and ran short of 10 gauge shells. We had to drive to Paducah, KY to by more ammo.

Interesting. I don't know how I'd feel if my home state treated me with greater suspicion than a visitor.

Actually, I think I do.

I'm glad I'm a Kentuckian. My last gun purchase took five minutes, over four and a half of which was spent BSing with the seller after the deal was done. ;)

Don't know if it was house ruies or state law. It was a very minor pain in the rear as we were staying in Metropolis, IL and it was only about a fifteen minute drive to Paducah, KY.

That is not entirely true. You do have to have a foid card if you are an IL resident. As far as out of state, it is similar to many other states. If you live in a state that shares a border of IL such as WI, IA, IN, MO, or KY, you can purchase a long gun and/or ammo for a long gun. You cannot however buy a handgun or handgun ammo unless you have iut shipped to your local dealer. This is the same thing with AL. I have dual residency as I am from AL and moved to IL. I can buy a gun in AL cash and carry, but have to wait in IL!

Moving to IL was like moving to a third world country for me! :D I grew up in the country with a 100 yard range literally in my back yard!
 
In Ohio in order to buy a gun at a gun show, the dealer must be licensed. You as buyer fill out a form that asks if you are a felon, an illegal alien, etc. You say that you are not, sign it, the dealer runs a background check then and there, adds the serial number of the gun to the form, and keeps the paperwork that goes god-knows-where. You hand him/her money, they hands you the gun and you take it home.

The time I travelled from Ohio to the Indy 1500, there was a guy who had a booth and wouldn't sell me a 1954 Highway Patrolman because I was from out of state and he didn't know how to do the paperwork. I did however pay $400 for a cloth holster that happened to have a 1954 Highway Patrolman wrapper up in it, which allowed the dealer to bypass the paperwork. :rolleyes:
 
Thank God I live in the Great State of Texas, and our leglislature only gets to meet for 6 months every two years. That doesn't give them alot of time to think up crazy damn fool laws to annoy the tax paying citizens.
 
Here in Illinois we have to pay a fee (tax) for State to issue us a Firearms Owners Identification Card (FOID). To use our Constitutional right, we can't buy a gun or ammo without one.

Soon, we will have to pay a fee (tax) to get our Freedom of Religion Practicing Card (FRPID) before we can enter a place of worship.

There will also be a charge (tax) to obtain a Freedom of Speech Identification Card (FSID) if one plans to even write in to a newspaper, post opinions online, or be interviewed on television.

Here in Illinois, there are no Constitutional rights without paying for them through a tax first. 7 more years and I get the heck out of here.
