Sunfest here in West Palm Beach does the same, held on public streets, even though it has no authority for doing so under state law. Not that I would spend $20 to wander around in a crowd, but I'm waiting for the first case/lawsuit to emerge.

SMSgt, I used to live down your way. I'm a bit surpised that has passed without challenge. S. Florida does seem to think they are not beholding to state law. i suspect that will be a challenge similar to the one the OP posted.
