is 1905 4th change 32-20 a curio and relic?

I have a curio & relic FFl and would like someone to tell me if I am wrong in thinking I can have a 1905 4th change 32-20 shipped direct to me. I think it should qualify as it is over 50 years old but the dealer I bought it from does not want to ship with out proof. I can have it shipped to a local dealer but that will cost another $25.00
I tried to call ATF but the best I could get is "leave a message and we will get back to you in 2 or 3 days"

you are correct any firearm over 50 years old is a c&r what dose he want proof of? that the gun is over 50 years or if you have a c&r license? atf usually hat no idea of the age of a gun. when i first got my c&r license i call them on a gun to verify if a colt i had was eligible. they had no clue.
 
Any 1905 4th change is a C&R gun and I don't believe S&W made any 32-20 guns post war. The dealer that sold the gun to you probably has a Blue Book, copy the section on 1905's as it included manufacturing dates and sent it along with a copy of the C&R book page that classifies any gun over 50 years old as a C&R.If I recall, there is a section in the BB also that defines C&R guns.
 
The short answer is yes, but the selling dealer may refuse despite any evidence, in which case you are stuck.
 
Some FFL's do not like to ship to C&R's. I've sent links to the C&R section of the ATF's website showing what the criteria is for a gun to be considered a C&R gun, and still some dealers refuse to ship directly to me. The cheapest FFL transfer in my area is $35.00 and it really pisses me off when I have to pay that additional fee.

Some dealers refuse to ship to C&R's because a C&R license can't be verified on the EZ Check system. The only way to verify a C&R is to call the ATF with the C&R license number. I wish the ATF would include C&R's in their verification system.
 
I don't think he knows what qualifies as a c&r and since he can't find it on their list he does not want to ship. The problem is all of the lists I have seen are of guns that qualify for reasons other then age.

To summarize:

1. That gun is definitely a C&R
2. Yes you can legally receive it on your C&R license. That's the purpose of a C&R license.
3. The seller can tell you to go pound sand, which is what he's done, and you can't do anything about it.

I've run into this more than once, even more than twice. Bottom line is that many dealers are nervous about their license, and rightfully so: That's how they make their living. I never argue with them about this and pay the going rate if it becomes an issue.

I have sent a copy of my C&R FFL along with the same ATF Q&A page mentioned by member (1blindref) also a copy of page 2 of ATF Publication 5300.11 that deals with what it takes to be recognized as a C&R firearm. The seller gives the manufacture dates of this revolver as being made from 1915 to 1940 in his listing so he knows the age. I think Dosgatos is correct. The seller is just nervous about his license.
I told him after reading this if he is still uncomfortable shipping to me just email me and I will have a local dealer send him a regular FFL.

If he insists on sending the gun to your FFL1, maybe you can get him to split the transfer fee with you??
 
Personally, if the seller doesn't know that a gun made no later than 1940 is a C&R,
then I would not deal with him. No 32-20 is worth that kind of nonsense.
