M&P 45 Fixed...mixed feelings about CS

So I originally posted the thread about my M&P 45c and the frame not being straight. It is a brand new pistol. Never fired. Just brought it home and noticed that the frame was not right.

I emailed CS and sent them the pictures of the frame and they told me to send it in for service. 5 weeks later...finally...they get back to me. The gunsmith says "We are going to replace the frame." I am happy that everything was going to be fixed.

While I am happy to have my gun back and I can say it looks better and is working properly, there are a couple things that bug me about this.

I sent in a brand new pistol and it took them 4 weeks to even look at it. Because I sent the gun in with no mags as per their request, I was expecting to at least get a new magazine (the one I would assume they used to test fire the weapon). But, it looks like they sent the firearm back to me without even a test fire. At least it works.

But it also really ticks me off that I also have to pay a transfer fee from my LGS to get my pistol back due to the SN change. I understand that new paperwork as to be filled out and that a new PICS check needs to be done and I can not fault my FFL for charging me the fee to do this.

I really think S&W really should take care of this fee. I spent almost $600 on a new pistol, never fired it, was without it for 5 weeks, then had to pay an extra $25 to get it back...all without even getting a new mag out of the deal (like so many people on here say they get in this situation). :rolleyes:

Okay, end rant. I am just happy to have me M&P 45 back! :D

By the way, I took it out today and I love shooting it. I did have 2 failure to feeds but I narrowed it down to the ammo causing the problem. Tula Brass...good, Federal Estate...bad.

They might have test fired it, but since it was just the frame that was the issue, they might not have needed to, since the action was verified to have been fine when it left the factory the first time. As for the "extra" magazine that you were expecting, the simple answer to this is that they may not have them, as ALL magazines are in extremely low supply right now. (And sending your gun in for service in no way means that you are entitled to, or will get a free magazine anyway)

In all honesty, you should be glad they even swapped out the frame for you instead of just sending it back with a "no problem found" tag, as your "problem" wasn't really a problem at all.
 
Is the dealer who sold you the gun the same dealer who did the transfer on it's replacement? If so I would be having a discussion with that dealer about charging me to transfer a replacement for a defective handgun that he sold me.
 
I hope not, because if it is, it looks like it has the same issue with the gap that the OP originally complained about in the other thread, which by the way, some of the pistols in the S&W catalog have as well.

And the slide has the stainless rollmark. They stopped applying that a while ago. Not sure what's up with that. :confused:

I have a few pistols that look like the frame is droopy. Does not bother me a bit, they all shoot great!
 
It took about 6 weeks to get my M&P22 back from S&W. I don't see this as unusual.

Regarding magazine, I agree it would be a nice gesture, but since they are in short supply I can understand why you did not receive one. I did not receive one either.

Regarding transfer fee, this is totally unacceptable. Either S&W or the LGS needs to eat that cost. Did you purchase the original gun from the same FFL? If so, they really need to transfer it for free or $1 for the books. If you had it shipped to a different FFL than the original purchase, then S&W should reimburse you. I know it's only $25, but now you've paid that twice for no fault of your own.

It was a different FFL. This is the one closer to me and that I usually deal with. They gave me a break on some other things I got when I picked it up so it worked out with my LGS. I do think that S&W should expect this and allow the LGS to bill them for the transfer. I have no problem with the fee from the FFL because that is their flat fee for every transfer.
 
Check out the BATF web site. They don't have to ship it back to a FFL because of a Ser. No. change. They can ship the new serial number back directly to you. But they chose not to do so due to company policy. I just went through the same thing. I did get them to pay the FFL and transfer fee.

to anyone.....ask a Taurus owner.
 
I can understand if they repaired your gun, they could send it back to you w/o a FFL transfer, but if they send you a different gun, how will the new ser# get on the original 4473 you filled out for the original gun at the original gun store? In other words, how will the replacement gun have a paper trail that leads to you? GARY.
 
The new gun will be logged in the books of the company that holds the licence that shipped you the gun. That is what it says on the BATF website. There is no requirement to ship the new back to the dealer. Twice Beretta has shipped my new guns and once Remington shipped me a new gun. S&W and Ruger wont say it is company policy.
 
The op chose to go to a different dealer than he bought the gun from.If he had went to the original dealer he purchased it from proabably would have been no fee.
