Various gun groups have filed an appeal to a lower Federal Court asserting the SAFE Act to be constitutional.
Will the 2nd(mostly anti-gun) do a flip flop and uphold what is right?
The brief filed is in plain English and even I can follow it. IMO, it destroys the state's case. but courts are quite partisan nowadays.
The SCOTUS has already ruled on "common" firearms.

here's hoping for the best but at the same time
realizing its the second circuit

the 9th and even the DC judge give us some hope.

There used to be a vehement anti-gunner on the 2nd, he was out of Brooklyn, I can't remember his name or if he still sits on the bench. He was as bad as they come.

Correction: he was on a lower Federal court not the 2nd.

There used to be a vehemently anti 2A woman in the 2nd Circuit. She was also the most overturned judge in the Circuit. Unfortunately, she's now on the Supreme Court.

yes he is still around. he is 93 and is a senior judge. he also still teaches in law school at Brooklyn College.

The liberal left tends to vote its ideology rather than the constitutional merits of the case. The Heller case should have been 9-0 instead of 5-4.

As I live in New Yuck, I'd love to see the SAFE act thrown out but I'm not holding my breath.
