I know this bill passed and was supposed to take effect 90 days after passage. So, are ccw holders now exempt from ncis checks as the bill was supposed to do? I asked a local dealer about it today and he thought I was crazy. Contacted the governors office but no answer yet

I heard back from the governors office. It did pass and they are applying with batf to get evaluated to allow ccw holders to bypass background check
 
I foresee issues and problems since a) the permits do not have photo ID at this time and b) there is no accessible state database. Remedies for this promise to be expensive and intrusive. The local sheriff's departments are in charge of the process currently since the courts ditched the responsibility because they couldn't milk it for funds enough to satisfy them. One suggested solution was an endorsement to our driver's licenses but that get's the DMV involved and no one has explained how that will work given the local sheriff's turf verses state involvement with costs and administration. Usually when these types of issues come up, gun owners and permit holders are not the beneficiaries of the eventual result.

A local dealer told me (being on the border here) that Virginia does not recognize this in WV for these reasons and contiguous sales of shotguns and rifles are not kosher. Handgun sales over the line always have been and will continue to be verboten federally.
 
I had the exact same question some time ago - shortly after it went into effect. I spoke with my Sheriff, my ffl, the AG's office, and my state delegate.

Here's what I found out:

SB 353 make WV CCW permit "eligible" for exemption from the instacheck by bringing WV code more in line with federal requirements. However, it is still up to the Feds to grant the exemption for which our CCW permits are now eligible.

The AG (and Gov) should be the office(s) to petition the Feds/ATF for the exemption. Now that election season is over and WV has a new AG to be sworn in, WV residents should pressure incoming AG Morrisey to move forward with this. The previous AG was also pro-gun, but it just didn't get done in his term.

Sheriff tells me the bg check for CCW has not actually changed - only the code was tweaked to meet the eligibility standards. All counties should now offer a photo CCW, but some (like mine) will charge an extra $5 for the photo version. I still have the old style (no photo) but will get the new style when I renew next year.

Until the Feds grant the exemption for which we are now eligible, expect to go thru the instacheck when purchasing a firearm.
