the dealer did but he wont sell it for a loss.cant really blame him he needs to eat . i blame smith

IMHO, if you have a written receipt of "deposit paid" on a given amount remaining due for a certain product, you have a contract. Unless there's some language in there somewhere they can not modify your agreement. Read the fine print, it may say you have no recourse.

But I didn't stay at the Holiday Inn lately.

Maybe they'll give your money back with interest. Personally that's exactly why I *don't* make such deals....any more....

Eh. I kinda hold the dealer on that one. I understand price increases. But I won't accept a lay-a-way payment on something I don't have on hand for that reason. Sounds like bad business to me. But that being said, that's just me. He should have either made that clear up front, or not do lay-a-ways.

Get your money back and keep looking. Sounds like the contract either never existed, or your dealer backed out.

Why are you blaming Smith & Wesson? What did they do wrong? If I order a customer a case of liquor, I cannot be sure what the price is untill I see the invoice. If you buy gas in the morning and the price goes down by afternoon, do you expect a refund of? And if the price goes up, do you go back and pay the difference?

Sounds like Smith did nothing wrong. Sounds like the dealer screwed the pooch on this one, and is now between a rock and a hard place.

I agree.

Any time I've ordered a weapon and paid a deposit, my receipt said "received deposit" then says "balance due." Does your say that, because if it does then the dealer is at fault.

Regardless of who's at fault, the dealer should be representing his customer. The dealer may not be at fault, but as a customer advocate, he should be calling the S&W distributor and pitching a fit to salvage the customer.

Best Buy did me wrong over a $25 purchase nearly ten years ago. Not only did me wrong but indicated that customer satisfaction was not a priority either. Neither I nor any member of my immediate family has ever stepped foot in a Best Buy since. If I needed something desperately and Best Buy was the only place that had it, I would do without! I take every opportunity, like this one, to espouse that Best Buy's customer service sucks.

Now, surely S&W wouldn't want to alienate a customer for life over a simple misunderstanding on their part.

If you put down a deposit, toward the final payment, YOU HAVE A CONTRACT!!!! Unless stipulated on the receipt, the "gunsmith" Does HAVE TO HONOR IT!!!!! Demand your deposit back.....he has broken the contract to pay X amount of dollars. Why should you lose anything?

If h.e won't............. Take him to small claims court. That's what they're for!!!! Bob

Dick's Sporting Goods in Syracuse used to sell handguns. They also had a stated policy that "they would not be undersold". I put a deposit on a S&W 469, back when that was a current model. Then I found one, brand new, for less at another area dealer (Ra-Lins/GEM Sport Supply). Went back to Dick's, told the salesman and asked that he adjust the price on the 469. He refused, saying, "We're not here to lose money". I asked for, and received, my deposit back. I suppose, if I pushed the matter to a higher level, maybe I could have got them to abide by their own policy. To me, a contract is a contract, and a man's word is a man's word.

Humor & indulge me if you will by telling me how much that cutting edge 469 went for, "back in the day."

I always liked that little 12 rnd "mini."

No way in hell would I order something a year or so out and expect the price to be held without that time frame and price spelled out and signed off on by all party's of concern.

Why should they give a turd, they put the "lock" on their guns, right?:p

have sent email to Smith there closed for holiday, it wasnt supposed to take a year but thats how it worked out. Getting deposit back is no problem. Problem i want the gun, but 1550.00 is out of my range. i will let you know how this plays out

Nick,

God's honest truth...I don't remember the price. I got my deposit back from Dick's and never did get a 469. I still like them. Passed up on a very nice, lightly used 669 about two years ago.

Thanks for the reply. I picked one up a couple of years ago. Seems it was $280-90 w/some ammo.

I like SS so at times I wish mine was the 669, but the serrated, bobbed hammer still is kewl in my book.

Sorry OP for the thread drift. Hope you get some satisfaction from S&W or your dealer.

I had two Shiloh sharps on order for 4-5 years... the deposit only held a place in line- payment in full guaranteed the price. They did go up in that time...

Every one is different I believe... then the bottom feeders and whiners get involved....
