UBC's via Executive action?

He is not going full Universal Background Checks. This is the same move that he telegraphed previously. He is going to designate regular private sellers who move many sales as gun sellers requiring them to complete background checks. It is directed at private sellers working gun shows parking lots and using Facebook to hawk their wares as private sellers, but they sell many firearms. They do a face to face transaction as a private seller rather than as an FFL holder requiring a background check.

He cannot institute full "universal background checks" without Congress, as much as he would like to.

He will issue an Executive Order, which can change a govt'm policy but is not a Law. Only Congress can create a Law. So, given what you said above, that makes some sense as to what the PoUS can actually accomplish.

Lol just lovely!

Here's what this is......we made up a phrase and have taken action to prevent it! Now all the kumbaya singing, hand holding pipe hitters can feel good about the world. All problems have been solved and we are now a peaceful species!!!

Obama this morning declared the CA massacre as "Gun Violence," not terrorism. Wonder why?

WOW, I go to a half dozen gun shows each year and have never seen a "transaction" in a parking lot. Most of the shows have large, easy to read signs, forbidding the practice.

If these folks want to change the way individuals do business let them go through congress!!!

Until then if I wish to sell a firearm to my neighbor it ain't none of their business................Lord, I'm sick of these fools....

It's not so cut and dry as some would think.

Under current statute, persons engaged in the business of selling firearms must obtain a Federal Firearms License (FFL) and conduct a NICS background check on each sale.

There is little guidance from the statute or the courts as to when a private seller/collector crosses the volume line into the territory where an FFL is required.

An Executive Order directing the BATFE to consider persons who sell 50 guns a year "engaged in the business" is likely within the President's authority, assuming that the statute regarding being in the business is not void for vagueness.

IMHO, it would help a lot of casual collector/sellers to know that unless they reach the 50 guns a tear level they will not need to get an FFL.

Hmmmm, and how do you suppose they could track how many guns a private citizen sells in any time period?

Upon reading any statement issued from these loons the first thing that becomes apparent is how they twist and manipulate the wordage to fit their agenda.

"gun show loophole" that allows people to buy weapons at gun shows and online without a background check

online is now suddenly comingled with gun shows. Last time I checked any gun purchased online and shipped must go to a FFL dealer. More lies and deceit. Stay vigilant.

I can't say for sure, but I think an in state sale between non FFL's set up online would not need an FFL or a NICS check.

I've often wondered what the penalty would be for not complying with an executive order. As pointed out only Congress can enact laws therefore a private sale of a firearm would not be illegal. After all, the police are referred to as law enforcement officers and not executive order enforcement officers.

Basically be a face to face with advertising done on the internet. Same as posting a for sale on the billboard of your local gun club. Any gun that shipped, even if it stayed in state, would have to go to an FFL. The percentage of internet deals done where the sellers meet FTF is probably less than one percent.

You can be sure they will come up with some scheme to include and ban internet sales even though shipped to an FFL. There is no end to the absolute nonsense these loons can think up.

All who aren't members should join the NRA and we all must stay vigilant.

Not so. LONG GUNS can be mailed from seller to buyer via the USPS without getting FFL's involved. Crossing state lines gets the federal government involved.

I swear the President personally wants every single American to own a gun.

He semi secretly met with Bloomberg, of take away your big soda infamy, to discuss his planned EOs, a fact which made the front page of CNN.

Now, as soon as everyone wakes up in the morning, everyone is Wyoming will be loading AR mags...and muskets... waiting for the Black Helicopters.

Which might eventually be arriving....

But the simple suggestion of EOs should motivate gun and ammo sales.

Agreed. In fact, he did motivate enough folks to legally buy over 185,000 firearms on Black Friday of this year. I read somewhere that since he's been in office over 100-million guns have been sold.

I don't see how any free American can not pay attention to, or trust, a president that comes out and publicly states after the massacre and maiming of Americans in San Bernardino that the problem was guns and not islamic terrorism. Of course, shortly before that heinous and murderous event he stated that climate change was to blame for islamic terrorism around the world.

Although we only have exactly 400 more days of the guy, it's going to seem like an eon before we can finally wave goodbye to him. Of course, we could be saying hello to another one we won't like or agree with, either.

Elections do have consequences.
