Lately, I've seen a few ads for firearms in which the seller stated he won't sell to NY, California residents, etc.
The process is the same wherever you ship to, rec'd by an FFL, so I can only surmise that this is some kind of political statement or a way to punish these states.
There are many 2A supporters in NY and we are hampered by a liberal governance. We'd like to move out, but many of us have work or famiiy ties here.
Maybe re-think this?

Maybe not a political statement. Aren't there were some restrictions in a few states that don't apply to many others? Maybe it's much easier for a dealer to avoid the headaches created by legislation in a few states and deal only with the many states that don't have the restrictions.
 
California demands far too much of out-of-state FFLs. There is a whole CA certification process so they may be "allowed" to send firearms to that state. Never mind that FFLs are regulated federally; CA does all it can not to recognize federal preemption on a number of subjects, just ask any over the road trucker.

Yes and no. Maybe, maybe not.

You can see in many ads how the seller says that it's the buyer's responsibility to make sure items are legal to own where they live. Well, I went with that too, but according to the ATF it's MY responsibility to make sure the item I'm selling is legal to own in the place where you live.

And this is probably what gives most dealers a headache. Most can't (or won't) possibly research all firearms/knife/ammunition legislation in all jurisdictions to make sure it's legal before selling/shipping.

Perhaps a buyer got it online, his jurisdiction forbids that item and now you have to put in the work and research before shipping. If indeed prohibited you now have to redo everything, give a refund and put it back up for sale.

I'm a small one-man-does-it-all place. I do research when people inquire. I have shipped items in restricted areas, and currently have a customer who wants a firearm but lives in CA. I'll work with you as best as I can so you can get the item you want, and we both stay legal doing so.

But busy big box stores or huge gun galore dealers might not want to put in the work. Or just simply can't because it's a lot, and I absolutely 100% disagree with the decision of the ATF!

I have had no problem buying handguns from out of state. My FFL is quite up to par on the gun laws and have had no problem.
Course when it got to my state it first had to be registered with the Sheriffs dept and that could take from a couple days to a couple weeks before I could posses it..

Now that was all before the new governess pushed through more Cuomo type legalization so I and about 99% of the state including LEOs realy don't know what is allowed to happen.
Glad I'm not in the market to purchase anything with a serial number at this time.
 
Constant legal ambiguity could make today sales illegal by the time it got to said communist infected state. Now you have a gun tied up in a lengthy process. Refunding the payment would be the easy part. The other part not so much
 
I would say no from what I have seen, but I'm not a lawyer or FFL

So much now is up in the air since the special session to adjust our gun laws. You get 3 people you will get 3 different responses!

That's not good. What do we pay these morons for?!
 
I don't blame them don't like it but don't blame them- I once found a Ruger new Vaq. with dual cylinders in Oklahoma gun shop on line was gonna buy it seller told me "We don't sell to California- you need to move out." lol. Yeah I know.. SAR's are allowed in the late great. The state does have wacky extra steps to ship here like I said up to the seller. And the late great rulers have a goofy rooster of guns that are allowed into the state that changes constantly.

That's why gun companies and venders who help out California buyers (Like Springfield Armory and Smith and Wesson) are appreciated and get my money when I need/want to buy.


I could say more but the cooler would get me again.

I Escaped 9 months ago (after being born and raised there - lived there for 68 years) - like removing the Empire State Building from my shoulders!!! Now living in a free State, it's a HUGE difference - even more than I ever imagined. Not just about guns either! Hopefully one day you will be able to adios as well.
