Executive Order?

Just got back from a local area gun shop. It was a fruitless search for reasonably priced .308 ammo. Interesting discussion while I waited with a couple of rather well informed customers. The discussion was "Executive Order" to make what Biden said about passing gun control by the end of January.

That was one tact I had not considered but given the "seriousness of the situation"...ahem, cough, cough.

I wonder how that would work and if it is even possible. Any thoughts?

From a WashingtonComPost article linked on Drudge: "In addition to potential legislative proposals, Biden's group has expanded its focus to include measures that would not need congressional approval and could be quickly implemented by executive action, according to interest-group leaders who have discussed options with Biden and key Cabinet secretaries. Possibilities include changes to federal mental-health programs and modernization of gun-tracking efforts by the Bureau of Alcohol, Tobacco, Firearms and Explosives."

BTW: I did finally find some ammo at another shop. Not what I wanted but enough to break in my scope next weekend.

It was my understanding that an Executive Order had to have legal standing already. For example, the President can't issue an Executive Order to legalize drugs.
 
The Administration is now showing it's true colors. With an election no longer looming, they are free to do what they want, without fear of political consequences. Any executive action in the second amendment area, without going through congress, or a constitutional amendment is purely illegal. The question we have here is, if this is done, who will stand up and challenge this action in court? Not the media, their first amendment is not under fire. Many of our politicians are lacking in backbone to do this. I don't know how many will stand up. I believe we have the majority of public support on our side, but the anti's scream a lot louder, and have the mainstream media support. I fear the NRA will have to carry the load of this court challenge, if and when it comes. This fight will take lot's of money. Then again, this all could be a grand bluff, in an attempt to get the congress to pass a lesser measure, avoiding a constitutional fight. If you are not a member of the NRA, join, if you are a member already, please consider contributing a few dollars to help in the fight. Personally, I am not all that interested in assault rifles, but I think we all must stick together on this issue.

The real question is not who,will stand up and challenge this in court but what will you do if you loose in court? That my friends is a very real possibility. Is something Constitutional just because 5 of nine say so?

Suggestion: please do not use "assault rifle", that is not correct technically, it is called semi-auto rifle, I have one, but I am not crazy about it, what I am against is the administration use this to cover up their real intention: disarm the American people.

If something like the 1992 LA riot would happen, then you need semi, other than that, there is practically no need for me to own one!!!

Ahem, I have a modern sporting rifle. Assault weapons are what the military use.
 
Rick, the entire world told us this would happen if Obama got reelected. No surprises here. Evil plays golf in DC every Saturday and takes a government Marine One chopper back home when he finishes. I expected this on Wed morning back in November and its only been a little over two months and its here. Welcome to the end of freedom in America.
