Obama is going to make this a part of his health care/gun confiscation package. If your taking any type of mind control drug you will be reported to your insurance carrier. You are just starting see the future of health care/big goverment/insurance carriers working together to control your lives through your meds. Today it is firearms, tomorrow it will be what kind of car you drive.
 
I appreciate all of the feedback. Have come to the conclusion that telling the truth is probably easiest..."had a gun sale 5 years ago and disposed of my guns". True statement... I culled the herd and replaced some I really had no use for with guns that I use. If he [she] persists a simple "No" will be my answer [this is probably the one best response]. Again, there were alot of very good suggestion and some very humorous.
 
The HIPAA rule change effective 4 Jan 2016 is a final rule, having been pending through the necessary prior public notice and public commentary process.
The change is in 45 CFR 164.512 (f).
If you go to the HHS.gov site, then to Laws and Regulations, then HIPAA Privacy Rule, then Special topics, then NICS

If you go to the HHS.gov site, then to Laws and Regulations, then HIPAA Privacy Rule, then Special topics, then NICS, you'll eventually get to a long-winded but worth reading summary of the process and the short text of the changes to 45 CFR 164.512 including the addition of (k) re release of info to the NICS.

T'any rate, on its face the new reg isn't as alarming as the speculation--including mine--was. But, first steps and all that...
Easy way to find it is to use your search engine to seek ...45 CFR 164.512...
When you get there, look for a link on eCFR (the official site) to the most recent amendment, Jan. 2016, adding 164.512(k).

If I get asked any question about guns. I give them a true honest answer. "I do not believe in "A" gun". I say nothing more.
 
Rusty, can you give us your interpretation of this reg for those of us not versed in gov lingo?
 
No real need to ask, it's always sitting on the chair next to the exam table. Never worry about a two-finger prostrate exam. :-)
 
It was my first one in early 2009. Doc didn't ask me on his own, but was reading from a Federal form printed on pink paper with all the questions listed, one after another. I haven't see one lately, so I don't know what the current procedure involves.

Don't matter what year it was, I have NEVER had any medical person ask me if I had any guns!

It may be that they only ask in certain areas or states?
 
My doctor knows that I have guns because we go to gun shows together and shoot together! :D But with other recent treatments and hospital visits those doctors have never ask! ;)

Maybe the post I just entered in the 2d Amendment forum will help some. I have neither the computer, nor the mental, capacity to try to lay it all out there. Basically if the present Senate bill 2002 gets passed, the new HIPAA medical privacy reg could be beneficial. ( But then, all laws and regs are believed by somebody to be beneficial to somebody...it's in how they're ignored or enforced)
 
Never had it asked around here, I think they assume it. If asked if I have "a' gun, the "correct" answer is no. :D

I would never tell them the truth about that; it is not relevant and I don't want it in the record. Since most of my physicians (primary and two specialists) have known me since before I left LE, I am sure that they just assume so.

Tangentially: one of my doctors, who is not comfortable about guns, was really pissed about a prior patient who had been carrying IWB and when he had to take off his shirt, revealed being armed. He obviously did not consider that "concealed means concealed". All that does is make enemies for us. (The building is posted, which no one with any sense heeds, but ... be discrete.)

When he asked I fired back with "Do you sleep with your nurses?" He looked at me and said "what" in a real confused manner. I told him his question was about as inappropriate as mine and he needed to stick to what I was paying him for.

At which point he marked the "Yes" box and continued the interview .

Someone doing that is the reason our local Concentra Urgent Care Clinics are posted. An armored car guard decided to disarm before stepping on the scale and then decided to clear the weapon for "safety's sake" instead of just leaving it in its retention holster on the counter right where he could see it.

Long story short, in the process of "clearing" the weapon he put one through the wall.

About a month later I went in for my yearly UA and as soon as I walked through the door (in uniform) they stopped me and without even questioning if I even was armed ordered me to return to my car and disarm.

After that experience I don't blame them.
 
I don't want to start a fight but you are WRONG, as an FF, I will tell you that the info that you put on your gun purchase paper, STAYS WITH THE FFL until he dies, goes out of business, or just retires, THEN the paperwork is turned into the government. Then it gets put into warehouse and if you are lucky, some dip**** puts it in a record list. They are running about 2 yrs back on that job right now, ask your FFL.
