Yeah, but that's a pretty good deal for them. If every member is paying $40/month, that's $1.6M/month they're bringing in. $19.2M/year is pretty decent income for a service that has a very small likelihood of being needed.
Ultimately, it can be good for them and good for us. The more members they have, the lower the cost should be. I doubt they intend to lower their premiums though.
I would venture that most members have the base policy which is either $149 (LE and MIL), or $179.
Coverage for civil trials and (up to $1MM) judgments adds $220 annually.
(There are discounts that can be applied via various training sites to the best of my recollection...)
So, assuming that most go with the standard policies, that would be significantly under $40 / month (on an annual basis) per member if my presumption is correct. More like $12 to $15 per month.
If you have assets, liability coverage could make a great deal of sense, however.
