because there is no penalty when they do.

This can be the penalty even in blue states with red rural counties if conservatives and conservative public interest law firms would start pushing it.

42 US Code Section 1983

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer's judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.

I feel for you guys.

I live in a very rural county in the deep south. The county has passed a 2nd amendment sanctuary law, the sheriff has stated that the department will not enforce any gun control legislation and the prosecutor is a very conservative Baptist.

the demographics of the south are changing also,so it may happen where you live eventually too.

enlighten me

Think of FL. It was a purple state with 500,000 more registered Ds than Rs. Now it's a red state with 800,000+ more registered Rs than Ds.

Or TX. Talking heads were pondering if TX would turn blue in 2016. It's more red now by a long shot.

I was going to mention both of those states. Thanks for saving me the work. I'd add Ohio to the list, it used to be a toss up stated, but in 2016 and again in 2020 it was clearly red.

Every state seems to have pockets of blue no matter how red it might be. My son used to live in Alabama near, but not in Mobile County. His county voted 80% for Donald Trump in 2016, but there were still some hold outs.

I'm happy to be in a state where my vote for a Republican counts.

I'll stop there with the hope that I didn't go over the dreaded "into politics" line.

All of these states know that their laws will be overturned. They are just trying to slow the process down as much as possible and hope that eventually they'll get a "reasonable" Supreme Court that will reverse Bruen.

And that's exactly why conservatives need to start using 42 US Code Section 1983.

As stated before, it takes years for a challenge to reach the SCOTUS. And when/if a law gets overturned, most states will have an alternate law with same meaning, different wording ready to be passed. It'll take another few years for THAT law to be challenged. Ad Nauseum.
Look at what New York has been doing for the past couple decades.

Your right. And that is why conservatives need to start using 42 US Code Section 1983.

It permits civil suits for damages to be filed for the deprivation of Constitutional civil rights against INDIVIDUAL government officials (except judges) with personal liability for those officials for depriving citizens of those Constitutional rights. Bruen and previous recent SCOTUS decisions, like Heller, have made crystal clear 2A rights are individual, civil, Constitutional civil rights.

A little forum shopping - so well practiced by leftist - can provide a pro 2A jury.
