But not by the whale. The whale calls him Chum.
The local authorities have charged the kayaker with harassing wildlife. They issued him a cetacean.
The kayaker has appealed the charge. He claims the event was merely a fluke.

Prior to ingesting the kayaker, the whale says to his buddy,"Here, hold my beer."
or
This was a very sophisticated attempt by a Venezuelan illegal to gain entry into the US by using a whale as cover.

"Desperate times call for desperate measures." Maybe he figured he could become an American cetacean if he kayaked there.
The whale's reaction was obviously a gag reflex when its PTOOEY!-tary gland was triggered.
His father needs to use different bait when he is trolling,maybe one of his smaller children?
