Default MURDER IN A SMALL TOWN - AGAIN

It was maybe 7 years ago that we took this guy in for killing a girl.
He was very cocky and claimed that he did not do it. At the scene of the crime was a young blonde girl who had been strangled. It appears that she got mixed up with this loser and got hooked on drugs.
The loser plead his way out of a murder charge. He said that he choked her, but she was still alive when he left. He returned and she was dead.
He pleaded down to a lesser charge and got 5 years. Five years for taking a life.
He got out of jail after the five years, That was about 2 years ago. Just 2 months ago he and his new girlfriend (isn;t it amazing how quick they find them) set fire to a apartment where a really nice gentleman had let them stay for awhile. He had told them that they had to leave.
The FD discovered a dead body in the fire. Yes. it was the nice man who let them live there.
They were first charged with setting the fire and were in jail awaiting trial. Well, we connected them with the killing and now they are charged with murder.
Here is a guy that 7 years ago killed a girl, and is now charged with murder again. I really cannot wait to see what he pleads to this time.
This guy should have not been out on the street.

When they got John Gardner, the guy who murdered Chelsea King and Amber Dubois (and others, no doubt), they found he had been CAUGHT... not "suspected"... CAUGHT... multiple times violationg his parole. They KNEW where this guy was... except for the times... yes... "times" plural... his ankle bracelet battery ran down...

This guy was SUPPOSED to be behind bars. But he "fell through the cracks." How does that happen? In this guy's folder is a name or names. These are the "cracks" this guy fell through. The person/people responsible for his whereabouts. He/she/they need another line of work.

The answer? Another law. I threw up in my mouth a little when that useless pig gubbornator and his gaggle of cronies posed for the cameras and announced that children were safer because of Chelsea's law.

There is no real deterrent to committing a capital crime anymore. For example, when I was a young man rape was a death penalty crime. Today, even with DNA, that crime can be plea bargained down to a couple of years in prison that will probably be written off as 'time served' due to the length of a speedy trial these days. Crazies who slaughter people are excused because they had a bad childhood. The examples are too many to enumerate and all arise from the same idiotic thinking that puts the welfare of the perpetrator above that of the victim.
I for one would welcome public executions again so that those unfit to live in a civilized society would know that major crimes did not mean just three hots and a cot, but an automatic trip off the planet.

What state is this in? I understand in the USA our legal system requires most defendants to plead "guilty". Therefore incentives are given to get them to plea and move on. If the guy served 5 years of a 5 year sentence, he probably wasn't rehabilitated. Usually you can get time off for good behavior and parole if you show you are sorry for the crime you committed. I feel sorry for the family of the murdered man. I can't say what prompted him to help this loser, but it looks in hindsight like a bad decision.

There is a trial going on here where DHS workers allowed a little girl to be neglected (criminal neglect) on the Cherokee Reservation. After the girl died, the workers (yes, more than one) falsified records to hide their incompetence. Apparently they weren't any better at this action than they were at protecting the little girl. They are on trial now. Sad to say, had they not falsified records, there wouldn't have been any criminal charges and who knows, maybe no administrative action. Now the Tribe is looking into creating their own social services arm.

IF the county is working on the reservation and trying to monitor a child welfare case and charges need to be files on a parent your talking a Federal judge has to be involved. Crimes on Native Land is investigated by the FBI. At least on the Res I worked on that was the case. I had to deal with rape, incest, murder, and child abuse. I quit because I could bear to watch people die because of the slow action/inactions of the BIA and the FBI and tribal police

AS others have stated above, it is a "legal system", and not a justice system. The legal system work for the benefit of those within the system, not for the benefit of justice. watch it at work, and then count the taxpayer and other $$ involved funneled into that system.
My opinion, based on observation.

Probably for the same reason there are people down here with their 7th offense DUI but they still have a valid drivers license. The last dummy had i think 4 DUI's and he ended up crashing head on with a family on their way home from church on Sunday morning. The crash ended up killing all of the family members in the other car. The stupid drunk happened to be the only one who lived.

Judges, Lawyers and DA's are the ones who need to be blamed for people like this being out on the streets. And in this case, people like this who still have a valid license.

I've harped on this before: If rape is a capital crime, that provides an incentive for the rapist to commit a second capital crime--the murder of the raped woman. Why shouldn't he kill her? She's a witness, and they can't execute him twice. If rape isn't a capital crime, maybe he'll take his chances and let her live.

The way i have always seen it. If you do harm to another, it should only be fair the same harm be done to you.

I know that 2 wrongs will never make a right. But the 2nd wrong will surely make a great example. IMO, we as a country need to stop coming up with excuses and start making more examples. After you make a few examples of people who do wrong. Sooner or later the next person who thinks about doing wrong will look back and say "If i get caught, i know for a fact what they will do to me, and they arent going to make me famous either".

As long as we as a nation believe that violent criminals can be re-habilited you are going to see these perversions of our lenient justice system...We are not talking about shop lifters here...Fact is our penitentiaries are jammed full. No room in the inn..so to speak. The rush to bring a case to it's quick conclusion is more importent than justice....Throw in the natural feelings of out most liberal citizens and you have a system that has been broken for years....It will get no better, the system itself will not allow it. It is about clean-ups as fast as possible. Move on the the next case, actually the next ten cases..The real answer is so expensive it defies any reasonable solution...Death penelity maybe, but now if it takes 10 to 20 years to see it to the conclusion......I have been employed in this judicial system for over forty years, with all the so called reformers and the liberal bent of our justice system it has just become worse, slower, and plugged up with crazy delay, and misguided belief that the recidivist number can be reduced...Hasn't worked yet, I'm waiting!!!! I give you the Jody Airias (Sp?)Case...Are you kidding me, what justifies the time and so called drama of this so called speedy justice. How much has this case cost....I guess it was important to see this murder stand on her head...Heck she has the whole system standing on our heads...She is laughing....Her day in the sun....I wish it could be measured by days....This case of a person that admits she is a killer will be with us for years and years....Justice delayed is justice denied..

FIVE YEARS?!?!?!?

And the guy that let them use the apartment?

It won't matter if they lock him up for 50 years, he will still be a piece of crud when he come out.
