What is the best non-lethal weapon to use, that is legal for US citizens to own and carry.

IMHO the better the weapon of that type the more it tends to go into Less Lethal, not non-lethal.
That, my friend, is a contradiction in terms . . .

Your brain. Failing that, a high-quality OC spray. And, to forestall thread drift, the bear pepper spray is probably best suited for bears. Check local laws for that stuff...we Floridians aren't allowed to have that. Guns, yep; all manner of pointy lethal objects, sure; fireworks, check; blunt objects, no problem; Tannerite, yup. Bear spray, nope. Clearly, the Florida NBA (National Bear Association) lobbiyists bear watching.

There are plenty of non-lethal options, none of which I carry. There's always a good-sized one-hand-opening knife on me, but if it comes to knife fighting, it ain't coming to knife fighting...
A stun gun means somebody is too damn close for this slow old man to deal with.
My choice would be the strongest capsaicin stream available, with a range of at least fifteen feet, but all I carry is my EDC gun and my steel cane.

Anything you want that you can stick in you pocket. Dirty undies would have the most advantage in the gross factor, especially if you tell them just as you start swinging those bad boys. No one, no matter how tough, wants to go up against soiled cotton.

My state of Michigan won't allow stun guns, knives over a certain length, some pepper sprays or a loaded long gun in my vehicle. Since my last successful back surgery my cane stays at home on a hook.
That pretty much leaves me with the 38 in my pocket as I'm too old to fight anymore.

Yup. All I need to do is put a couple in the ten ring. I am confident of my ability to do so. A Ruger LCR in .22 WMR or a NAA in .22 LR are two of my favorite carry guns. Very, very few self defense incidents are going to involve a Weaver stance, a two hand hold, and sight alignment. I'll be reaching for my own sharp knife with my off hand.
Side note: If it's you, how you feel about taking a couple in the chest or one under the chin . . . ?

In large part the answer to this question is going to depend more on your fitness and skill set. On the high end of the scale would be some form of martial arts.
The first thing that you should do is make yourself less of a target.
Next, improve your chances of escape without engaging the threat. Women should try to stay away from wearing heels—wear shoes you will be able to run in. If you need to wear heels somewhere, bring shoes you can run in. Know the area you are in. Know the quickest way to a gas station or minimart or bar that will be open. Don't burden yourself with overly heavy bags or briefcases.
If initial escape is not a practical option, you want to incapacitate the threat long enough for you to get away. The problem with most self defense tools is that unless you have had hours of training, using them under stress can be awkward and detrimental to your survival. Where you keep it can also really limit its effectiveness. Learning certain strikes and grapples will go further in high stress situations than having a weapon.
OC spray is a popular choice for non/less lethal weaponry. Personally, if I needed OC, I would get the Kimber Jet Protector which gives you two high velocity shots of OC. The impact from the Jet Protector stuns attackers and if you double tap them, it cannot be used against you in the case you lose retention of the device.
The OP's question was for non-lethal so let's get away from firearms & blades. Pepper spray has been covered but shouldazagged and brian_41 mentioned they used a cane but neither has considered their cane as a weapon. With some training in in cane or walking stick fighting use, it can be a very effective weapon. The bonus is that it can be carried anywhere legally without question.

A cane. Legal everywhere including planes. Highly effective even with minimal training or strength.
