Default Gen Z legal woes – The “Sad Beige Lawsuit”

My gf sent this to me, with much shaking of the head. We are clearly SO not in sync with modern life

The “Sad Beige Lawsuit” and the Fight Over Social Media Influencer IP Rights

Several paragraphs long, but here's the gist:

Can you protect a personal “aesthetic” or “vibe?” Social media influencer Sydney Nicole Gifford believes so, as she recently sued fellow social media influencer Alyssa Sheil in Texas Federal Court, in what is now known as the “sad beige lawsuit.”

Both [are] social media influencers who promote Amazon products over their respective social media feeds using a predominantly “neutral, beige, and cream aesthetic.” Gifford claims Sheil copies her “neutral, beige, and cream aesthetic” and “vibe” by replicating her photos and videos without attribution, which in turn has resulted in a loss of earnings. Sheil immediately sought dismissal of all Gifford’s claims, arguing, among other things, that it is impossible to steal an aesthetic or vibe of an individual...

Gack. Who ARE these people?
From a People (ugh...) article:
Sydney Nicole Gifford is a 24-year-old social media influencer who's amassed nearly half a million followers across Instagram, TikTok and Amazon Storefront...

The content Gifford creates centers around her home, fashion and "must-have" items she finds on Amazon. She stands out because of her neutral-toned vibe, curating her content with shades of brown and tan hues.

"I think I feel more calm in neutral spaces,” ...my favorite color is beige," she added, which explains the hashtag she'll occasionally use on her content (#sadbeigehome). "It is a sad beige home, and I like it."
(A "sad beige home"? Are you kidding me? )
Alyssa Sheil is a 21-year-old content creator who shares fashion and lifestyle content with her nearly half a million followers across Instagram and TikTok combined...

...All of her posts ... are neutral-toned.
"It’s definitely very calming,” Sheil said... "I just want it to all be cohesive and plain."

Where there is money involved there will be litigation, so no surprise some attorney is willing to attempt to float this by a judge to see what might stick.

The money some of these folks make is serious.

Better hang on to your hat, OBH, with those two on the loose. (They'll be after your vibe for sure...)

I associate "sad beige" with Honda Accords driven by balding guys with thick glasses and a turtleneck that are only doing 40 MPH when the on ramp to the freeway runs out.

We'll know how effective those influencers are if OBH becomes oldbeigehat.

Well played, sir! I'll check my hat regularly for signs of "influence" and report back if there is any fading.

I don't consider myself an influencer, but my dog follows me (when I'm holding food).

That behavior isn't limited to the class you suggest. Maybe 60 years later I still recall the older lady I followed up an on ramp. She'd been moving pretty good so I was looking for a slot in traffic to enter. When I faced front, I found SHE'D STOPPED! Fortunately, there was room to go around her and I got into my prechosen slot. I expect the two ladies said rude things about me.

Apparently, the practice of being up to interstate speed by the time you're nearing the traffic flow isn't taught in driver training. Moving over a lane to give entering traffic a break is apparently limited to us geezers and big truck drivers.

Yes, it's called "Trade Dress". Like Taco Cabana vs Two Pesos
