Dog Attack

Long time ago I used to work in a store and i had a regular customer. He was an older guy, with some scars on his face and two hooks for hands. He was kinda gruff and a curmudgeon. Scared the women, but I got along with him great. Finally one day I asked him how he lost the arms. They were both amputated mid-forearm. He told me the scars and the arms were the work of 3 dogs. He turned the corner into a cul-de-sac on his walk one evening and saw the 3 dogs trying to get at a young girl, maybe 7 or 8 who had crawled under a car to get away from them. They were trying their best to get at her. He yelled at them and they came for him. Somewhere in the midst of it, the girl ran home. Meanwhile he was fighting all 3. They were Rotts and big enough to push him over. So, most of his struggle was him on his back, jamming his fists into their mouths and kicking and screaming. It wasn't until a neighbor fired a couple of shots in the air that the dogs stopped their attack and ran off into the bushes. He got a ride to the hospital, where they took his arms and patched his face as best they could. The dogs? They were found the next day at a park. They came right up to the officers, tails wagging, asking for pets. They were taken to a shelter and later euthanized. Nobody knows why they decided on violence that day. They were fine, gentle animals according to the owner. Never hurt a flea. By the way, the girl had some scrapes on her from crawling under the car, but was otherwise unhurt. If 3 Jack Russels come after you, you punt the little yappers across the street, but when the dogs come a little bigger, it's a problem.

. . . I wonder what the consequences would have been had I shot the pit bull and ended the attack?

Tom H.

In my jurisdiction, none.

If a unleashed pit bull charged at me and Daisy it would not make it very close. I've been there and done that and have pictures of the carcass to confirm it.

I don't have a problem with put bulls, I have a problem with irresponsible pit bull owners.

My general-public opinion? If you were defending your life (or the dog owners life) from the pit bull attack it would be a no-brainer. But shooting an attacking dog to save another animal … that is a slippery slope that depends on your jurisdiction and circumstances. I’d think twice for sure.

Hope all turns out well, and am thinking you did well to use discretion under that pressure.

that right there is the sticking point. The pit wasn't attacking a human. in a pinch, it could possibly be argued that the pit only stopped there because it was preoccupied with the dog it attacked. Could be enough to sell a jury of an SD argument, but it's a situation best avoided.
