I picked up a couple antique Smith & Wesson revolvers online located in Ohio. Is Ohio now required to do background checks to ship antique firearms out of state from auctioneer to individual? 😑 No big deal either way just would like to know how much I'm in for for the transfer if I need one lol

Interesting comments about Ohio not allowing the sale of antique guns without a background check? I always have used the Gun Zone to check on state laws and the link is below. It was last updated in Feb 2024. I cannot find any gun laws for Ohio newer than 2022?


Second argument is BATF laws should override state laws, especially when the state does not even address antique guns in their legislation and the BATF does.

Problem is that some sellers ignore the laws and regulations while requiring all guns, antique or otherwise to go through a background check and FFLs. Ridiculous, but the only thing I do is ignore them and not buy anything from them again. I once was asked to fill out a 4473 form for a flintlock pistol and refused so the seller canceled the sale.

I once purchased several civil war era carbines at a small auction where the auctioneer did not have an FFL. After the auction, I was informed that a Greene's carbine (British type) from 1855 had to be transferred via the pawnshop down the street. I pointed out that the carbine was made in 1855 and used paper/linen cartridges that were no longer available. I was told they (the FFL) had contacted the ATF about this rifle and were told that it could be modified into an automatic weapon and therefore had to be transferred. Blew my mind...but it's a rare firearm so I paid my $25 and took it home.
Stupidity and ignorance is out there. If you want what they're offering, roll with the tide. I was banned from another auction because I questioned a transfer requirement on an antique Parker shotgun. I was right, they waived the requirement, and I wasn't allowed back. Not really sure if I won that argument...:unsure:
Turns out he (the auctioneer) was less than forthright. He was charging my friend sales tax on vintage US currency-that's not allowed in my state. He said he had consulted both his attorney and CPA and they both told him to charge it. A print out from the secretary of state's website changed his mind. My friend wasn't banned, but I was. I guess my demeanor just isn't as sweet as his. ;) I'll live through it.
 
I've had similar situations where the sellers were requiring an FFL for antiques. Before bidding I asked why? Their responses were either uneducated, or that is was simply their policy.
 
It's been the same , people that operate gun stores tell me they do not know the laws

I asked a guy if that meant he did not know what he was doing essentially.....

He stuttered and I told him he's hurting his business.

Every auction house I have contacted in Ohio is willing to ship an antique direct when I inquire. It is what it is

Im not sure if anyone knows anything. All the way from the top where the 'law' is manufactured all the way down.
 
I’m still waiting for shipment of two antiques form an auction house in Ohio. After paying for the items, I waited 10 days for my shipment and finally emailed them. There reply was “ the owner put them in his book so now I have to send them a local ffl. I emailed them my C&R ffle that same day, which they didn’t see until I called them a few days later. I was assured my shipment would be a priority and they would send tracking info. That was 7 days ago and still no word. This is from a May 15 auction. I will likely not bid on any future auctions originating in Ohio. Pm me if you want to know the name of this auction house.
 
That doesn't sound good. I'm in same boat. Waiting. Have to have my FFL over to theirs.
Then they will quit whining and I can have my guns. Nobody knew the laws whatsoever. Shops. Auctioneers. So I said screw it and put them on a form and get them out no games and I buffaloed the guy into eating shipping and transfer fees.
