i have this .38 5 shot smith break action with serial number523312. patent info is may 11 1880 and april 9 1889. can anyone shed any light on this as to when it might have been made and what the model actually is?

Welcome to the Forum. You have a 38 Double Action 4th Model made just before the 5th Model came out. The revolver was shipped around 1908-1909, so it would be classified as a modern handgun by BATF and is subject to any registration laws your state might have. These guns do not command much in terms of value unless near 100% condition.
