A Realstate Question.

Hopefully a Florida agent here aboard. Question : You buy a home that's older 1972. In 2015. Lets say you find out now in 2017 that it's a possibility that previous owners or owners didn't pull bulding permits for lets say screen room additions up to a one bed room block mother in law cottage. Would that not be found in title search ? My biggest question is that on seller to disclose or is it on buyer ?. Note these buldings in question has been on property most likely 20 to 25 years. Any help would be great. This came into question this week when I called a roofer out due to some hurricane damage. This roofer said he could not touch it due to previous permits not pulled.

Get a different roofer! Never ask a realtor to do a lawyers job! Even if they are honest; the little details are what can save your rear end! My family has been in the non-sales end of real estate for over 50 years!

Some title insurance includes coverage for non permitted construction. I would check that documentation first.

Re on obligation to disclose, seller or buyer, seller. Only obligation buyer has to disclose is proof of funds to buy, if asked.

I agree with advice to find a different roofer.

If he is pulling a permit it will probably come up. How does one pull a permit and put a roof on a structure that's not there?

What county are you in? If it's been 20-30 years, they probably wouldn't have records showing whether or not a permit had been pulled, and may not care. If it was done in the last few years, that's different, but there are still procedures to get permits and bring unpermitted work into compliance.

Many properties are "Grandfathered" in. Building and zoning codes change.

They took the adress down and claimed they did a search with parcell numbers and aeiral views
