No, it wasn't. It is part of the U.S Code. Title 10, Subtitle A, Part II, Chapter 47 of the United States Code.
And, just who is it that writes the US Code - A BUNCH of DAMNED Attorneys and the basic UCMJ was suggested/propsed by the JAG Corps of the Army and the Navy.

Unless the UCMJ has been changed he'll be on "leave" until the Court Case is finished and then will be "Separate for the Good of the Service" under a General Discharge but could also face Courts Martial and a DD if it is determined that he had been "On Post" before the accident and "knew" the Ohio law and thus was in violation when he left the Post. Also, depending upon when the Post Regulations are he might have been in violation of them as well and could be charged in a Courts Martial for basically the same offense. From what I've seen the Post Regulations generally follow those of the State in which the Post or Base is located. Doesn't sound good to me.

Believe it or not, there was a time when the article in question would have found it's way into someone's locker, to be seen again when all else was through.
 
He was home on leave when the incident happened, so right now the military is taking a Wait and See stance. It's a bad law to begin with and just went into effect a few weeks before the incident.
 
I guess the other thing that aggravates me is that when I was in the military I know at least a couple occasions when police officers gave me a pass. I wasn't doing anything overtly wrong but I know I received warnings when I could have legitimately received a ticket or even maybe a ticket when I could have been arrested for a more serious charge.

My older brothers have a few similar stories. Some of you know what I mean, sometimes when you've been gone for a while you forget how to drive in civilized society. He was in an accident. He had not been drinking, just a moment of distracted attention. He justly received a citation for the accident.
 
I get the impression that the Indian city police had unloaded weapons when the terrorists hit Mumbai. Somewhere - maybe on the forum somewhere - I saw a story about a photographer who got pictures of the terrorists at the train station.

He said he wished he had a gun. He said he saw police with guns and he was demanding that they shoot, but they did not. Either they were scared, didn't have ammo, or didn't know how to shoot.

My dad was in the Marines, and during the occupation of Japan, he carried the mail on the train by himself. They gave him a .45, but he said he wasn't trained on it. I didn't think to ask if it was loaded. Maybe he didn't even know.

Mean streak, I don't think so. Although sipowicz and I often have different thinking, I think we both treat people the way that they indicate they need to be treated.

When I was an undergraduate, the college I was attending finally got approval to arm their campus police. I was in the Chief's office one day to get a parking permit and he walked past me to get to a drawer in a file cabinet. His Model 36 in a OWB holster was right at eye level to me and I noticed it was unloaded. He noticed that I was looking and said something to the effect that the pistol without the bullets was enough of a deterrent. I blurted out that he should be ashamed of himself and that even Barney Fife carried one bullet for emergencies. Guess what...I didn't get a parking permit that day.

I carry an unload gun-from the cleaning bench back to the closet where I get a single .45, 9mm or 40 cal round, walk outside, chamber it (always fearful of a malfunction and the round going off in the closet, paranoid I know) then back into the house to insert a full mag.

I hope you are not inserting the round into the chamber without using the magazine...that is very bad for the extractor....

An unloaded pistol is:
1. a good paperweight
2. an invitation to be beaten to death

Other than the collectibles in my gun safe, all of my handguns are always loaded and ready to use. Raised two kids that way, now I have eight grandkids from 9 to 22. Never had a problem because everyone was TRAINED and knew that there simply is NO SUCH THING AS AN UNLOADED GUN!
 
In Germany, I am forced to carry my hunting guns (both long and short) unloaded, while on the way to the hunting ground.
But I am allowed to carry the ammo in the mag or speedloader.

I am allowed to load the weapons, when I arrive at my hunting ground. From there, I carry them loaded, until I leave the ground.

Sounds silly, but its the law in germany since 2003. Before, hunters were allowed to carry a loaded handgun for selfdefense on the way to the huntingground, too.

Normal subjects in the "peoples republik of germany" are not allowed to carry weapons, no matter if loaded or not, and even the mere possession without a legal reason as sporter hunter or collector (everything confirmed by staate exams) is a felony :-(

Change the Garand to an M-1 carbine and the same with me on guard duty. The live ammo mag had to be in my pouch..Damn, not sure why that was the reg, but I obeyed orders...
Likewise had to walk guard in the 1st Sg Bde wire and cable yard at night on Long Binh Post with an M14 mag containing 2 rounds inserted but wasn't allowed to chamber one.

I guess I got that from loading my old pump shotgun as a teen. One in the hole, shuck the action closed, 4 or so more in the mag tube. Is what you're saying that if the round is stripped out of the mag the rim will ride up the face of the bolt/slide under the extractor instead of the extractor having to bump over it? If so I appreciate your advise. I never thought of it! Thanks.
