BRAVE NEW WORLD and I don't like it one bit, no

I like it. If'n I was to show up in a classroom in a golf shirt and skivvies, no shoes, the SRO would slap the cuffs on and haul my &&& away. Also, I get 8 hours sleep a night, eat when I want, go on a 4 mile walk in the middle of the day, and when the spirit "moves" I don't gotta get coverage while I walk 1/4 mile to the can. Joe

I won my first "computerized" tax case last week. The judge, government attorney and I were on camera. My "Boss" was home with the camera turned off. Between my brilliant arguments, I could hear what sounded like the crunching of potato chips. It is hard to beat the government on collateral estoppel, but I managed this time. The period of appeal expired last week and the government declined to appeal. Maybe this is not so bad, especially if you are sitting in your pajamas eating potato chips.
As long as it is a purely document case I agree, ZOOM ain't too bad. but once you throw in live witnesses it goes to hell quickly especially when the statutory law has not caught up with technology

I'm not a lawyer and I've never played one on TV, so bear with me.

If you can SEE the witness on Zoom, why is it a problem to conduct a cross examnination?

This is interesting for sure!

I'm still in commercial construction material sales. We work with building owners, architects and installing contractors. In the past it was a breeze to set up an eye to eye meeting to go over new items, product changes and so forth but 100% of all our contractor customers have a "no contact" policy for guys like me and the architectural firms are exactly the same.

The solution seems to be virtual meetings like "Zoom" or "Go to Meeting" and as of today, we're spending a fair amount of time and money to better understand how this technology works.

It's certainly better than having no contact with our various accounts but I also wonder if this won't become the new norm.

I hear you and lend a sympathetic ear; although I cannot help or give counsel...;):D

What I can say this. If you know what is right, and in accordance with your ethics, stay the course. Right will always come to light, I believe.

Some people wrangle their hands, shake their heads about what they say or do, but I don't. If I said it, I believe it, if I did it, I believe it was right. I'm not perfect and make tons of mistakes--just ask my wife--but at the end of the day I sleep well. Stay the course. Best, TH

THE JUDGE

Well we have a judge here in Winchester that has not rendered his final in my sons devorice case in almost 8 MONTHS. I find this appalling to say the very least. Any further comment would get me a ding from the Great one. I just cannot help but wonder how anyone can justify being so lazy and incompetent ??

The already backed up court system is going to experience severe overload as things open up. Right now judges are denying requests for continuances on contested matters and threatening to dismiss cases in an effort to clear their dockets. I am not an attorney, but have many that represent us and there is a pig in a python right now.

Activist judges have been an issue for us across the entire country.

The next few months will be interesting.

I think the duck blind sounds like the place to be Caj.

Good luck with that come next election time or when the state appeals system gets totally jammed up.

A good attorney can pick up body language, and possibly even smell the fear, when witnesses are lying. You get none of that on Zoom. Lot's of clues can be missed when you aren't cross examining in person.

I served on a jury for wrongful dismissal private party suing a car dealership. When one of the witnesses came in the room you could feel the hatred between these two women. Interesting experience that could not have been duplicated on TV.

I agree that it works better in civil or tax cases better than criminal, today the Head of IRS Legal said that Zoom litigation and hearings was a "silver lining" to COVID and they are looking at how to do a lot more of it going forward. I suspect your powers that be have similar thoughts. They can have the case on the computer running the case and watch the ball game on the TV next it.

What's idiotic is that the latest report from the CDC shows that the corona virus has a 99.74% survival rate.
Ain't no way I'm gonna cower in fear.
I have a better chance of getting killed by a lightening strike than to die from the corona virus.
From the way it's reported you'd expect to see the streets lined with dead bodies and mass graves.
