California Ban on Hi-Capacity Magazines Overturned

It's a great ruling. It's even better if it's interpreted to overturn the long standing ban on purchasing new high capacity magazines. If that happens:

1) It'll make other states think twice before they try extending the scope of existing bans; and

2) It'll lead to Constitutional challenges in other states with bans on high capacity magazines.

Now will Kalifornia have to allow pistols and rifles for sale if they have hi-capacity magazines. These 7- 10 round capacities leave us with the possibility of being outgunned. The outlaws don't worry about using hi- capacity magazines and weapons.

Freedom and liberty are not outmoded concepts!

Thank the stars and stripes for men like Judge Benitez.

I would expect the 9th circus court to overturn this district judges decision.

This article is from March of this year. Hasn’t this been set aside already?

My understanding is that the ban is essentially back in place (i.e., judge's order stayed) while an appeal before the 9th Circus is being heard. I've seen no updates on that since last month.

Yep. This was big news in California six months ago. "High cap," i.e. standard capacity, mags were legally available for a week before the stay went into effect. We call it "Freedom Week" out here.

Stay will remain in place while the commissars slow walk it through the appeals process in California. Likely to take years. If it goes to an "en banc" appeal in the 9th Circuit, which is almost inevitable eventually, it will surely be overturned.

The last thing the Kaliforniastan regime wants is to provide a vehicle for the Supreme Court to overturn this bull****. They can't actually prevent that, but will make it take as long as they can, which, judging from past practice, is pretty long.

Well I guess it pays to read the whole news article and check the dates. Darn it! I just saw my Range Officer this morning and thought about mentioning it. Hope springth eternal!

Well, the good part was that they've estimated 5-6 MILLION "regular" mags were ordered during that week and per the judges order were legally delivered and possessed awaiting the 9th review - kind of poked a hole in the attempt to confiscate grandfathered mags
