Can A Widow Get Husband's Social Security?

Usually you have to be married to someone at least one year to get survivors benefits, unless they meet an accidental death.

However, if she was married to him for more than ten years before the prior divorce, she could get divorced widow's benefits if she is at least 60 years old - there is an earnings limit, just like for retirement benefits.

Kids and other factors can affect things; Social Security benefit entitlement for widows/widowers and children can get very complicated.

Before anyone starts blaming the dadgum gubbmint, the original laws were reasonable, but over many years court cases filed by attorneys have greatly expanded the right to entitlement, because as every one knows, you can't pay widows and children too much or too often. At least that's the way it seems sometimes.

Assume a couple both draw Social Security. Upon one of their deaths, the survivor will draw the higher of the two benefits as a survivor.

If the wife never worked, and never drew any benefits, she would draw the spouse's benefits upon his death.

When my father died in 2001, my mother drew the higher of his and her benefits.
