Change to medical weed law in PA for gun owners

Upon the implementation of legal, medically prescribed marijuana in PA, the states plan was to include all prescribed users in several law enforcement data bases, including firearm purchase back ground checks and federal LEO reporting. Any marijuana card holders would automatically be banned from buying or owning a firearm.

After considerable outcry, the state today has decided not to list card holders in any law enforcement data base. Whether possessing a firearm while in possession of prescribed marijuana is still an arrestable offence is unclear from what I have read. My understanding is you have to be actually under the influence while in possession of a firearm to be arrested (though I could be wrong on that)

Personally, I am glad the state of PA decided not list medical card holders on these law enforcement data bases. It makes for a slippery slope. If medically prescribed marijuana where to make you a prohibited person, then what about other mind altering medications, of which there are plenty. Most folks here take some form of medication. Read the labels, you may be surprised how many caution about "driving / operating heavy machinery". You could be next... Maybe a regulation that requires booze purchases be reported and listed as well?.......:(

While it's good that PA didn't follow through on this, the larger issue is that it's a violation of federal law to use or possess marijuana. Question 11e asks about that and has a note in bold letters that use of Marijuana is a disqualifier under federal law.

Lying on a 4473 if also illegal.

So, you either tell the truth and no FFL will process the 4473, let alone sell you a gun. Or, you lie and hope that no one ever finds out that you lied.

This could be solved by Congress repealing the law that make Marijuana use and possession illegal.
 
Keep in mind that merely possessing a firearm and a controlled substance is punishable with an enhanced sentence under Federal law.

You don’t have to be under the influence of the controlled substance and in possession of a firearm to get the enhanced sentence.
