"Cop in bar fight video gets 2 years probation

CHICAGO - An off-duty Chicago police officer convicted of pummeling a female bartender half his size has been sentenced to two years probation and anger management classes.

Cook County Circuit Judge John Fleming sentenced Anthony Abbate (ah-BAHT'-ee) on Tuesday. He also imposed a home curfew from 8 p.m. to 6 a.m. and ordered Abbate to perform 130 hours of community service.

Prosecutors had asked for a prison term. But Fleming said he didn't see any aggravating factors to justify that.

Earlier this month Fleming found Abbate guilty of aggravated battery for the February 2007 attack.

The bar's security camera captured a drunken, 250-pound Abbate punching and kicking the 125-pound woman. The footage circulated widely on TV and the Web."


Let's review:

"Prosecutors had asked for a prison term. But Fleming said he didn't see any aggravating factors to justify that."

Really? Then explain THIS:

"Earlier this month Fleming found Abbate ***** guilty of aggravated battery***** for the February 2007 attack."

What part of "aggravated" did this enlightened jurist not comprehend just weeks after convicting the cop of AGGRAVATED battery?

Anyone think Joe Sixpack would get such a BS sentence after being caught on tape pummeling and kicking a 125-pound woman?

Should be in prison. Period. Guys like him are the reason a lot of people don't trust and respect the police. (And the judge is equally to blame for screwing up the criminal justice system...)
 
I just seen it too. Looked like a grizzly bear beating a little cub. Nobody like that should be a cop. I wouldnt judge about prision term or length of it, but if he stays on it should be in the garage lubeing cruisers untill retirement!
 
No suprise in Chicago!

Visitors Beware! If you get in a fight in Chicago get your licks in on the street. There is no justice in the Cook County Court system! I know first hand after my son got beaten by 5 people during a home invasion last year. He was beat with pipes and 1/2" breaker bars and had to undergo facial reconstruction surgery and has permanent injuries including brain damage, loss of smell and loss of hearing and 4 plates in his head and face. The 5 were charged with MISTOMEANERS, 3 went to trial with 2 recieving probation and the 3rd getting supervision. We are still awaiting the trial of the other 2 but I'm sure the outcome will be the same.

The Felony Review Board said that because my son had no permanent injuries the showed like a missing arm or leg, so the State would not try these thugs on felony charges. The 5 were charged with criminal trespass and battery. The battery charges were dropped and now it's just the trespass charges.

Just more Chicago Sull bhit. This cop should be in jail! The beating this woman took for refusing to serve someone that was intoxicated and the outcome of the courts is a fine example of how the justice system DOESN'T work in Chicago.

Are you freaking kidding me?! It's "justice" like that that gets vigilantes taking care of things. Not saying I condone street justice but when the courts hand out wrist slaps it's no surprise when people get fed up and take care of things themselves.
 
Who's getting "lubed?"

OK What comes with this "Lube Job?" Does he get to keep his Benes' And time in? Transferable rank or a good early release?
 
Abbate claimed it was self-defense and has refused to apologize to the woman he beat. I guess he was dying for a drink and had no other choice.

What is even more frustrating than the wrist slap sentence is that he hasn't been fired yet. The CPD is "looking into" termination proceedings. (Insert head-banging .GIF here)
 
All I meant by that by being a grease monkey, he aint got power on the streets. I am glad I am not a judge, or he would never see daylight. But then I dont know his past and how much crap he took as a cop or what good (if any) he done as a sober cop either. Thats why I am glad I aint a judge. He should be happy I wasnt her daddy or husband.

There is no "justice" in America! There is only the application of law. Application by people. Aggravated assault seldom gets jail time, unless there are permanent injuries or the assault was with a weapon. I hate to disallusion some folks, but, there are one hell of a lot of crimes that are not prosecuted to the fullest extent possible, and a lot more that the punishment is "probation". Personally, I think that is at least part of the reason this country is in trouble!

Sorry for the rant. Oh, by the way, no way he should have been a police officer for very long after a very short investigtion.
 
I saw the video, too. He gives us all a bad name. He is obviously one of theose who got into the business to make up for some deficiency in his life (or his feeble little mind). The video made me sick to think that everyone who sees it will only identify him as an LEO, not the piece of human trash that he is. I agree that Federal charges should be filed. I don't care what the bartender is supposed to have done to him (maybe she questioned his manhood; God knows I do), there is never a reason to beat someone like that.
 
I believe police should be held to higher standards than the rest because we are supposed to trust our lives to them then there is this woman beater and he gets probation, and people wonder why I have lost faith in the juditial system, more crooks than there is help
