Denied purchase of a Hand Gun. :-/

I attempted to make a purchase of a new handgun today at a local gun store. I probably purchase a couple a year. I filled out the paperwork, included my SS#, and a copy of my DL & CCW. The background check took forever and I was denied the purchase and given a CN number and told that it should be cleared up on November 2nd.

I'm pissed; not a the store by any means; at the process. I certainly understand that procedures may need to be in place that attempt to keep felons from purchasing and owning guns. I've never been charged with anything other than a traffic citation many years ago. A call to the FDLE number did not satisfy me. They are sending me an application for a UPIN # so that I will not be held up in the future. I want an explaination. I always thought that including my SS# was to eliminate the possibility of my common name being confused with a bad guy with the same name. How can I properly and effctively complain about this and get an explaination. Thanks, - jerry

I was not given a reason. Several attempts to call the Firearm Background Section of the Florida Department of Law Enforcement (FDLE) for more information have failed so far. The recording says that they are experiencing a heavy call volume. Florida does not use the Feds - they do there own. They kept my money so I'm thinking they expected it to be "cleared up" by November 2nd. Three day wait? I'm still researching.
 
I finally was able to speak to a rep from the FDLE. She would not tell me why I was delayed. She did say that it is a delay and not a denial. She stated that the SS# does not clear the application everytime because they don't always have the SS# of the person who has been arrested. It's still frustrating. I'm sure i"ll cool down. I bought a new Sig P238 Copperhead and wanted to go shoot it with my sons tomorrow. There will be more tomorrows and I have other stuff to shoot. I did learn that this is not that uncommon. They are sending me an application for a "Unique Personal Identification Number" (UPIN). It includes a fingerprint card but once approved, will keep this from happening in the future. Interesting that they already have a fingrprint card on file for my firefighting certificate of compliance, firesafety inspector's license, and CCW license. Now they need another one. Go figure.
 
I don't know if Florida is different, but here in Texas, if you have a CHL, they don't do the check.

The good news is, it is a delay and not a denial. While frustrating, you will get your gun.
 
In Florida, if you have a CWP you don't have to wait the three days when you buy a pistol, but they still have the call-in.

I thought, though, that one of the provisions of the new gun laws that went into effect on October first was that CWP holders did not need called in any more. Was I mistook?
 
Often times, a delay is simply due to the time of day it is called in. I have never been delayed when buying in the morning time. Buying in late afternoon, I am delayed most of the time.

The call taker may be getting 50 calls an hour from hundreds of miles away and cannot handle all of them immediately. They take the info down and approve as they get it in the system.

A delay is nothing more than an annoying inconvenience.

The store does not have to call the NICS system if you have a CHL Permit. Were you meaning to say you had such a permit when you said "CCW"??

if your name matches anybody with a record, they will either put it for further review, and the person calling the NICS will be sent to somone else to do a lil check and often let the deal proceed----if that agent can't clear it up quickly, (via whatever records or computer they are looking at) they will delay it. Common names do not help you in this regard.

As for you being ticked, I AM TOO!!!

Having a CHL does ZERO for one during a gun purchase in Louisiana and many other states. Every purchase has to be called in.

Actually I wish LA did have the system in place to use CHL but because someone has a CHL does not mean they are still eligible to purchase a handgun. Even a revoked permit can still be in the person's possession. They could have committed an armed robbery, shot a spouse or many other crimes during the interim between getting the permit and buying a gun. For example, currently Louisiana has about 3,000 suspended permits due to crimes and domestic violence. So I can see why the Legislature will not approve such a system. Also I am not sure it meets with the Instant Background Check laws. This year, a local PD has fired nine police officers because they committed crimes that will not allow them to carry a gun any longer but they still have their POST certifications until expiration.
 
I don't know if it makes you feel better, but it happened to me also. The fellow in the gun shop called in and he had my ccw in his hand. There was no explanation but he said I would have to come back in 3 days, turned out to be five because the weekend did not count. Neither one of us was very happy.
 
I have a friend or two in the FDLE, from what they are willing to say is that the " system " is somewhat overloaded. Rest assured no reflection on you or anyone else. Many complaints are simply the inability of even getting through on the line to call in.
 
A hold or delay/wait is way different than a denied. It happens for no rhyme or reason to some very good people. Do not worry about it. Yes it's a pain but nothing you can do.The store holds your paperwork and if they do not get a reply back within 3 days then you are good to go. Denied is denied (no hope) you an't getting a gun. Of course you could buy one on the street:rolleyes:

Having a CCW in Florida does not stop the background check just the 3 day wait for a handgun.

And the more people buying guns means the system only gets more overloaded.
 
A delay simply means that you need to reconsider the gun you want to purchase. A denial means you cannot have the gun you want, end of story. In this case, it sounds like the OP was given a generous opportunity to think a bit more carefully about buying that SIG, or finding something better.

Just a matter of the government looking out for consumers' best interests.
