any record of a NICS search has to be deleted within 48 hours iirc, so 2 days after the background check is run there's no record it ever happened.

True enough, but I will not totally discount the idea of an unauthorized database of firearm purchases. There's been too many instances of the Feds misleading the public to believe anything they say with 100% certainty...
 
I believe I have read that some states require that the test fired case with date etc and not sure what other data is sent to local law enforcement, perhaps the sheriff's office. Not sure what happens with it from there.

There is an empty case that was fired in each handgun that is shipped with the gun. In some states this case must be sent to the local or state police. I don't remember which ones but FFLs in those states generally take care of that, I think.


New York State had such a law....

After a few million tax dollars, an impressive, crime-fighting database was in place.

Guess how many hits the database got that helped solve crimes committed by criminals with guns?
You guessed it - ZERO. Not one single arrest or prosecution from their database. :rolleyes:

It seems that we pro-gunners have been right all along - legal gun owners ARE NOT THE PROBLEM!

The first thing we 2nd Amendment lovers need to understand is this; Our common Sense argument supported by the FACTS does not matter to those who wish to strip us our Constitutional Rights.
And, with each battle we win the war on the 2nd Amendment never ends. Those who desire to take away our right(s) continue to push their agenda with no end in sight. We cannot EVER say the war has been won and is over.
Much has been said about the so-called "assault rifle", "high capacity magazines" and etc.... I say this; if I hit you with a baseball bat it has now become an assault bat. If I hit you 30 times with the bat it has then become a "high capacity assault bat". It is NOT the gun, it is the mind-set of the person who posses it that is the problem. I know I am preaching to the "choir" here but I just felt the need to release some frustration.
 
For those purchasing in NJ, by order of his royal highness Governor Christie, NO NICS Check can be done by phone; a fax must be sent to the NJ State Police.

What do they do with those printed faxes?
 
If you buy a gun from a dealer you fill out a 4473 form. That form will have his info and it will list the guns purchased, but it is not submitted to the government. The FFL is required to keep it for 20 years in a filing cabinet somewhere, and if they go out of business they turn them over to ATF but ATF doesn't use those to build a database, they do store them.

The ATF facility in Falling Waters WV does exactly that, computerize 4473's from OOB FFL's. They make no secret about it. Joe
