FFL Signed Copy

Hi:
In my area FFLs fax copies of their FFL Licenses to other FFL Dealers for firearm purchases that they are going to receive for customers from out of state sales.
The FFLs do not give out signed copies of their FFL License.
I have observed sellers that will only accept signed copies of FFL License.
I have wondered if the fax copy is not legal in some areas ?

It might not be legal in all areas.

I have 2 dealers that give me COPIES SIGNED IN BLUE INK, they

are also MARKED AS COPIES.

I scan them and send to my computer to be used (E-Mailed) as needed to send to other dealers.

I've noticed different FFL holders have different ideas of what's 'legal'...and really many don't have a good grasp of the rules and regulations at all!

I've had some gun dealers just swear you must do the paperwork/call-in on antique and blackpowder firearms...These guys are idiots!

On the federal level, there is one law. There is a clearing phone number for any FFL (01) dealer to call and verify any other FFL (01) is still current and legit. It is perfectly O.K. for an FFL to accept a faxed copy since they can verify it. They cannot call and verify an (03) FFL C&R as they are not kept in the same system. Those require a hard copy, although some FFL's may accept a faxed copy as well.

I haven't sold a lot of guns outright (I most trade, or I have sold a few FTF privately) but the one sale I did using a FFL to FFL transfer, the buyer included a printed copy of the receiving FFL's license and info, which had been signed (it looked like an original signature) in the envelope the buyer sent with payment. When I took the gun and paper in to be shipped, my FFL dealer barely glanced at it.

I don't know if he checked it later or not, but he didn't question it in any way while I was there.

These guys are not "idiots" they are cautious. If your business depended on the ATFE for its existence you might be very cautious also. No they don't have to do the check for antiques and black powder but it doesn't hurt either. If a buyer has nothing to hide why would he/she worry about it? I sure don't.

Faxed copys (w/signiture,date,ect) have been legal since 2005.
Emailed copys are legal also.
Wether any individual State(s) have steped in and said otherwise, I don't know.

I covers 01 as well as 03 FFLs (manufacturer FFLs, ect.)
The burden of verification of the buyers ID is with the seller and so states in the GCA.
They mention using EZcheck, but as pointed out,,that doesn't work with 03 FFL's.
