Dumb question: is there any legal difference between the wording “must not be infringed” in the document and the second amendment wording “shall not be infringed”?

What the idiots at DOJ seem not to understand that passing such laws are in violation of the Civil Rights laws. They should indict the Governor and members of the Va General Assembly (who voted for this) for criminal Civil Rights violations.

18 U.S.C. § 242:
"Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death." "Shall" indicates something is absolute, not negotiable, unlike "will" or "may".

She needs to veto the bills or they become law after a period of time. An AI question answered.

AI Overview

In Virginia, if a governor does not sign a bill within the specified time, it automatically becomes law without their signature. The governor has seven days to act on a bill while the General Assembly is in session. If the legislature has adjourned, the governor has 30 days to act before it automatically passes.

Key Details on VA Bill Procedures:
  • Action Deadline (During Session): The Governor has 7 days to sign, veto, or amend a bill.
  • Action Deadline (After Session): If the General Assembly has adjourned or is in recess, the Governor has 30 days to act, or the bill becomes law.
  • Automatic Law: If the Governor does not sign or veto the bill within these timeframes, the bill passes into law automatically.
  • Veto Process: If the Governor vetoes the bill, it is returned to the house of origin.
  • Override: The General Assembly can override a veto with a two-thirds vote in both houses.

I was comparing shall to must, not will or may.
I asked AI and it seems must actually has a stronger connotation than shall.

From AI:

“Shall" and "must" are modal auxiliary verbs(or modal verbs) used to express obligation, necessity, or future intention. "Must" indicates an absolute, non-negotiable obligation, while "shall" is a formal, often legal term designating a mandatory requirement or duty. Both are considered "words of authority".
Key Differences and Usage:
  • Must: Used for absolute obligation, necessity, or inevitability (e.g., "All passengers must fasten seatbelts"). It is widely preferred in modern, clear, or legal writing to signify a binding requirement.
  • Shall: Indicates a mandatory action in formal legal documents or regulations (e.g., "The contractor shall provide a report"). It can also indicate simple future tense (e.g., "I shall arrive soon") or, in the first person ("shall I?"), a suggestion/offer.
  • Key Distinctions: While "must" is frequently used for, well, must (something you have to do), "shall" is generally seen as more formal, and sometimes, particularly in older texts or legal contexts, it can be confused with "should" or even "will”.
Legal/Technical Context:
  • Must: In legal and technical documents (e.g., technical requirements), "must" is widely regarded as the proper term to express a mandatory requirement.
  • Shall: In legal contexts, "shall" can sometimes be interpreted as permissive or directive rather than mandatory, unlike "must," according to Wex.
Common Uses:
  • Shall: Used for formal requirements ("The owner shall pay...") and first-person offers ("Shall we dance?").
  • Must: Used for personal or absolute requirements ("You must stop")

Sorta, maybe, maybe not related...drove through Western VA on the way back from South Carolina last Friday. Vote No and Don't Fairfax Us signs were everywhere. I assume its related to re-districting. Good luck to you guys in VA, hope your successful.

It is and there are plenty of those yard signs in central Virginia too.

Spanberger amended the assault weapons ban for clarity and sent it back to legislation. An obvious move to avoid backlash on the April 21 gerrymandering vote.

The General Assembly reconvenes for a special session on April 22 the day AFTER the redistricting vote (gerrymandering). They will take up bills with revisions kicked back by the Governor that she didn’t sign. She has until Monday the 20th to sign, not sign, veto or kick back to the General Assembly. Big political play. Any new legislation signed into law takes effect July 1.

Spanberger amended the assault weapons ban bill rather than signing it as passed, with her office saying the amendments "provide additional clarity to law enforcement as it relates to the firearms included under this legislation, as well as protect the use of certain semi-automatic shotguns used for hunting from WTVR

Spanberger is simply playing the shell game to hopefully “not upset” more voters for her unconstitutional gerrymandering scheme so she is kickin* the can until April 22nd.
This also gives her “the appearance” that she made “rational” changes to the law but the General Assembly would not agree…so she pulls a Pilot and washes her hands of it as she has let “the people decide” the fate of AR’s and other semi autos in the state.

Guess, I don't understand what the redistricting bill has to do with the gun control bill.

One deals with Federal Congressional elections and one deals with VA gun rights, that have been under attack for the past several years since control of the legislature changed hands. It just happens now the Governor agrees so it may be a bumpy ride.

Where was the outrage here when Texas did the same thing, only worse?

Not a fan of any of it but you can't call out one without calling out the other. And at least Virginians get a chance to vote on it.

Elections have consequences.

Da Gov, bless her heart, doesn't want to be seen by her supporters as "caving" to the rabble or to incite the opposition.

The outrage is due to the pending blatant power grab as Virginia very recently did a court approved redistricting. Also, (hoping this doesn't rate a ding) a few years after the 2020 census, Per the AP(?), the Census Bureau discovered they'd overcounted several states (they included "estimates") and undercounted several states-including Texas. The over/under favored the party in power.

The Virginia Governor hasn't redistricted anything.

If you are a registered voter in VA there is a vote on April 21 where the citizens will decide on the temporary redistricting at the Congressional level. I would suggest you exercise your right to participate in the process. This measure was in response to actions in other states. Not that I am saying that justifies it but lets not forget where and who started this entire mess.

Anyone in Virginia who didn’t see sweeping gun law changes coming this year truly hasn't been paying attention. The Governor has made no attempt to conceal where she stands so I just don't understand how one relates to the other.

The D's are not your fellow Americans stop treating them as such.
They will never stop till we are all dis-armed and subjugated.
America's most deadly enemies occupy public offices, not far off lands. 1861 is here whether you want to admit it or not.

Virginia is currently in the early voting stage of a proposed amendment to the state constitution which would redraw Virginia's 11 congressional districts, changing the make up from 5 Democrat controlled and 6 Republican controlled districts to 10 Democrat controlled districts. The final voting day is April 21.

By making minor amendments to anti-2A bills, the legislature must reconvene, vote to accept the changes, then send them back to the governor. This would put the actual date of her signing these bills at April 22 at the earliest. This means that news headlines of Virginia enacting sweeping gun legislation would not be published until after voting on the redistricting issue.

Gun owners have a bad habit of not paying attention to political issues until they make headlines, so the theory is that most of Virginia's gun owners won't bother voting because there were no headlines.

They absolutely relate...our esteemed Governor has decided that she will roll the dice and kick the can down the road on the assault weapon ban UNTIL April 22nd (day after the gerrymandering vote) for fear of "arousing more negative reactions" from the gun toting folks here in our state of Virginia. The gerrymandering law, if passed will also give democrats a 10-1 advantage across the entire state of dem vs. republicans so kiss goodbye any type of future common sense legislation and be prepared for an onslaught of anti-gun bills with their new majority if they win this!!!

I won't copy both of the above but if you live in Virginia and haven't received in your mail 20 flyers about Vote No or Vote Yes on the redistricting then you are correct you haven't been paying attention.

Then the multitude of commercials, signs and you know the news has been covering it non stop

If you don't know anything about that issue I doubt you have a clue that the gun control laws are changing either.

I guess I gave us gun owners more credit.

Point taken, but frankly I believe you are over thinking it.

And the redistricting vote deals with US Congressional seats NOT Virginia Delegate or Senator seats. The redistricting could effect National laws but not Virginia law making.

Not overthinking anything, what is being done here in Virginia is nothing short of an assault on our rights to own (keep) and carry (bear) firearms (arms) and to fundamentally and artificially alter our representation in congress. This is what happens when supposed supporters of the constitution sit back, don't participate in elections, and just allow things to happen.

No, this is what happens when people ignore the importance of demographic change.
