Dear Smith and Wesson Forum, I have a gun backround check question. why does it take 1 day for a long gun and 3 days for a handgun? why can't the government just pick a standard number of waiting days instead of having 2 different ones for different firearms. sincerely and respectfully

Judging from your location, probably that they think people will do more "harm" with a handgun, and wanted those extra 2 days to give the person a chance to change their mind.

Out here in the real world, it takes as long as it takes for the check to be completed. No waiting period.

BG check

It is a state law. Each state is different. Here in In we have only NICS
check, before , all you needed a carry permit and you were good to go.

It has nothing to do with the background check, that they could do in a matter of minutes.
The wait is for a "cooling off period", under a theory of misguided politicians, that if someone wanted to buy a gun in the heat of passion to commit harm, the three day period would hopefully give them second thoughts about their intent. Stupid huh?

My first purchase they had to call in the background check. It took about 5 minutes on the phone. Now I have a weapons carry license. My last handgun purchase didn't need a background check due to my license. I was checked out in the time it took me to fill out the transfer form, pay my money, and get change.

There is no wait period in Florida for a long gun. If you pass your background check you can walk out with a 12 gauge, AR, AK. 30-06, etc but must wait three days (unless you have a concealed license) for a 22lr handgun.

With the size of today's short barrel "assault" shotguns this makes perfect sense doesn't it?

What Diamondback said. You're in the peoples republic of Illinois. The wait is a cooling off period and is state law. The background check takes very little time. Throw Chicago out of your state and you'd be a lot better off.

Gun shop owner: Sorry, the law requires a five day waiting period. We have to run a background check.

Homer: Five days? But I'm angry now! Oh, I'd kill you if I had my gun.

A good friend of mine here in Illinois carried an unloaded shotgun in a closed case into a local gunshop as a trade in for the gun he was buying. In accordance with IL Law, he had to wait 24 hour for a long gun period. He looked the store owner in the face and said, "I walked in here with a gun but I have to wait 24 hours to walk out with a gun?"

Gun shop owner said, "Yes Sir, it's the law! You have to wait 24 hour as a cooling off period!"

My friend said, "Forget about the sale, I'll take my trade in gun back and I'll go home cause now I'm really mad!"

Gun Shop Owner said,"I'm sorry but I've already log your trade-in gun into my books! You'll have to fill out a 4473 and wait 24 hour to pick it up!"

Now my friend is really not happy, he waited the 24 hours and got the new gun anyway.

Sometimes it's just difficult living with in the law!

South Florida,Dade and Broward Counties are 5 working days.Handgun or Rifle.I think Palm Beach and Monroe are as well.
Pretty much the rest of the state it is 3 days.

I guess we are more safer here than the rest of the state.

Q.What do we have here that the rest of Fla. don't?

A.Most of the crud that the rest of the state don't want.

Here in Tennessee it's a phone check with the boys in Nashville and then we're good to go. If the systems working well, it's nearly instant.

And now the "crud" is seeping over to this side of the State.
Interesting, did not know that there was a difference??

Here in Virginia

Love it here....I can be in and out of a gun shop in 20 minutes, with gun in hand. (That is with a full background!)
I'll miss it when I get transferred from here.

It's really surprising how people take their local laws for granted. I had a boss from New Jersey once who knew I liked to shoot. He mentioned he thought about buying a handgun once but didn't think it worth the hassle. When I explained the process in Ohio he was shocked that a resident could walk in and walk out with a legally purchased handgun in 10-20 minutes. I was shocked at the idea that a person in the US could be expected to seek permission from a Government official for such a purchase.

With or without a CCW License or doesn't it matter?

In Fl which is very gun friendly compared to some States, if you have a concealed license then you can walk out with a handgun, no wait for anyone for a long-gun (passing the telephone call) Which is pretty idiotic to me as you only need to be 18, 21 for a handgun but can walk out with a lot more firepower and a case of ammo. Sir can I buy that AK and 2000 rounds of ammo today, well yes you can. How about that Ruger MII 22 target pistol? No, you need to wait 3 days. Might hurt someone.

If you trade a handgun towards another handgun there is no wait (isn't that nice?) but you still have to pay your $5 background check call. If you pawn a gun for needed cash and come back a day later and pay off the pawn loan, you need to pass a background check and pay your $5 to get your own gun back. Gotta love it.

Here in Ohio if you're a resident there is no waiting period and no fee for background checks. However even with the CCW I have to have a background check done.

In Arizona - pick out the gun you want to buy (the longest part of the transaction), fill out a 4473, show the nice man behind the counter your concealed weapons permit, give him the money, and walk out the door with your new baby. If you don't have a CWP, they have to phone in a NICs check (while you wait), usually takes about 2-3 minutes, then give the shop your money, leave with your new baby. I hate state laws requiring waiting periods, they are so illogical.
