Gun Broker question

The only way he could collect NC sales tax from you is if you travel to NC and physically receive it from him in that state. He cannot collect sales tax on an item sold and delivered out of state. Oh yeah, if NC is like most other states, he must be in a business licensed to collect sales tax to do so. Arizona has NO agreements with any other state for reciprocal collection of sales taxes, and no sales tax on "casual sales," i.e., between private parties, within the state. I agree with the other posters, sounds like a deal best walked away from.
 
He bombed you on your feedback; you need to reply to that and then leave an identical negative for him as seller: "Seller ignorantly or fraudulently attempted to collect sales tax on an out-of-state transaction, refusing to ship unless the additional amount he wanted ($42) was paid. His illegal demand voided the auction outcome." And mention that Gunbroker administration sided with you in the dispute.

Or something like that. I don't know how many letters they give you to describe what was wrong, and that may be too long.
 
His little decimal point error aside,,Either he just doesn't understand what responsibility he has as a sale tax collection agent/vendor for the State of SC.and he thinks that any sale he makes from his business in SC is to charged appropriate SC sales tax. No understanding of OOS sales.
..or he needs to make a Mastercard payment and you're going to help him out this month.

His problem, not yours. No need for you to pay more than you legally should.
He's got 4 feedbacks total, all in the last year. I wonder if they gladly paid the sales tax and gave the positive comments too.

Deffinetly make a feedback comment &/note the GB email.

man, it is bad that this is your first g-b deal! they go smoothly almost all the time! my honest opinion is that i would do just what you did. it is fairly common knowledge that you don't charge out-of-state sales tax, his ad clearly says that only s.c. residents must pay the tax, lots of incorrect spelling, and incorrect sentence structure. he even spelled 3 words wrong in his negative feedback for you! just run! and be glad you didn't dive in any deeper.

Gran Torino, it shows that you left the seller positive feedback at GB. In the future, don't leave feedback until you have the item in your hands and are pleased with it. It's doubtful you can reverse that now but you may be able to get GB to do something about the negative feedback the seller left for you.
 
Hey get this...

I asked him on GB, "Is the tax .07% as stated, or 7%? Do you charge sales tax for out of state sales?"


He email reply was... "As charged normaly but we have a tax free weekend at the end of the so we can get it out with no taxes as long as it in November"


Can y'all figure that out?

Like was previously stated, I have never had a problem on GB before. Too bad this was your experience. But I agree RUN !!!
 
I'd just tell the seller that I wish not to complete the auction and just forget it.
 
Don't pay it. I have purchased loads of stuff off of GB and never has anyone asked me to pay a tax when I wasn't from their state.

why are you ranting about paying sales tax and then give the seller an A+ rating? something isn't adding up.

Some states, including WA, has a use tax. Any item bought out of state is charged a use tax in lieu of sales tax. But this is collected by the resident FFL when you pick up the firearm. There is no connection with the state where you purchased the item.

Use tax is one way the state makes money. WA is 9%. If I traveled to SC and bought a firearm (or a car) and paid 7% sales tax, coming back to WA, I would need to pay an additional 9% - 7% = 2%.

edit: I would add that you are in AZ and therefore not subject to SC sales tax in your comments.

Gun Broker Question

I live in Lexington, SC and met a guy named Gary at a gunshow in Columbia, and he was trying to sell a S&W pistol that I think was stolen. If this is the same guy I would not walk, but run away.
 
I've done this and he told me to do what I want to do but he ain't shipping the weapon until I pay the tax. In this particular case the total tax he wants to charge is $42 plus change?? I have filed a complaint to GB but of course they take forever to reply...up to 48 hours...:(

I just wanted to make sure I wasn't out of line.

Speaking from personal experience, don't hold your breath waiting for GB to come to the rescue. In my situation, wherein a seller misrepresented a well-used gun as "possibly new and unfired", and shipped it with dented and dinged mags, GB reminded me that the only thing they do is provide a means for sellers and buyers to contact each other. They invited me to leave negative feedback, which I of course did, but that was small consolation.
