Gun in the glove box?

FWIW, as I understand the law in Texas, you can only carry a weapon in your car without a CCW license if you are traveling. It seems that every jurisdiction has a different definition of traveling. Going to work or shopping in a different county might count in some places, but not in other places. I have no problems with it as I live in Oklahoma, so I'm pretty much assured traveling status when in Texas.

That's correct. You must be a traveler to carry
in the car in TX. And that has to be across
counties other than the one you live in.
I can't carry one in the car traveling around
town, or in my county. You will go to jail if
they catch you. But if I'm on the highway, it's
ok. One thing.. It is up to the discretion of
the officer to some extent. Most can tell a
legit traveler, vs someone prowling around up
to no good.
I wish Oklahoma had the same rule. That way
I could carry one in the car the whole way
up to my place in OK.
But.. They don't, so I don't carry mine in the
car at all, even while I'm in TX.
I don't want to have to stop at the state line
to put away my pistol.
So I keep mine locked in the trunk with the
ammo up front in the glovebox or wherever.
I really oughta get me a concealed permit.
That would let me carry in both states no
matter where I'm at.
If I did carry in the car, I'd probably use my
center console rather than the glovebox, and
if I were to get pulled over, the first words
out of my mouth would be I have a pistol in
the console.
When I have them locked in the trunk, I don't
volunteer that I have weapons. I would wait
until they asked me. They will soon enough.
I've pretty much decided not to carry in the car
until I have a permit. Even if I stay in TX the
whole trip.

That is no longer true. They clarified traveling with HB 1815 that was effective in September 2007. As long as you aren't in a gang, the hand gun is not in plain view, and you are not prohibited by law from possessing a firearm, you can carry in your car when going to the grocery store or wherever.

Here is law in Kentucky from Kentucky Revised Statues:

527.020 Carrying concealed deadly weapon.

(8) A firearm or other deadly weapon shall not be deemed concealed on or about the person if it is located in a glove compartment, regularly installed in a motor vehicle by its manufacturer, regardless of whether said compartment is locked, unlocked, or does not have a locking mechanism. No person or organization, public or private, shall prohibit a person from keeping a firearm or ammunition, or both, or other deadly weapon in a glove compartment of a vehicle in accordance with the provisions of this subsection. Any attempt by a person or organization, public or private, to violate the provisions of this subsection may be the subject of an action for appropriate relief or for damages in a Circuit Court or District Court of competent jurisdiction.

That's pretty much the way I was taught, too.

.

In Arizona it is legal to have a loaded handgun in your center console or glove box as long as it is in a holster. If the gun is not in a holster it is considered "Concealed" and a CCW permit is required. Go figure..........

Lee, I have heard conflicting reports that if there is a passenger in the car and they don't have a carry permit they could have some liability. The gun (assuming it is in the glove box), would in fact be closer to them than me. Does that make it "out of my control?" (I have a CCW).

I do as you do,(but always wondered about the glove box option), the gun goes in a holster in the center console while traveling. It goes in my holster or pocket when I leave the vehicle and if I am going somewhere I cannot carry, it gets locked into the steel storage box that is cabled to the seat chassis.

I'm aware of the new ruling, but none the less,
many in Houston that are found carrying with no
permit are going to jail, gang member or not.
I've heard of more than one permit holder having
the instructors bring this up during renewal
recently.
The guy I work with just renewed his permit in
the last month, and they were telling him
stories of people with no permits going to jail
recently. Of course, part of this may be a ploy
to drum up business for the permit instructors,
but that's what I've been hearing lately.
I know myself, there is no way I would ever
carry a pistol in Houston if I didn't have a
permit. Like I say, a lot of it is up to the
officer, and I just don't want to take a chance
if I was pulled over by one that thought non
permit holders shouldn't be carrying.
If I decide I need a pistol in town, I'll get
a permit and be on the safe side.
I wouldn't be afraid to carry one on the TX
highway with no permit though.
To each his own on this one I guess..
I'd rather play it safe, and I'm also in
Houston.

That is a partially true statement. If a passenger is riding in the right front seat without a CCW permit and the gun is in the glove box unholstered they can be charged with carrying a concealed weapon...but remember if the gun is in a holster it is not considered concealed in the State of Arizona. The same is true for carrying in a center console.

One thing to be learned from all of these posts is that our Second Amendment rights vary from State to State, depending on how they are interpreted. To say we live in the Land of the Free is something that is argued in the courts everyday.......
