gun shows-private sales

i was wondering if they require background checks for 'ALL 'sales,private and gun show private dealers etc,how that would work.
will all sales have to be conducted at a gun shop or in front of an ffl ? I thought only ffl holders could call in the background checks.
i would think gunbroker and gun shop consignments will get very busy... any thoughts?

You'll pay an FFL $20-$30, plus the cost of the background check ($10 here in Tn). At least that's how transfers are handled here now.
 
Most states have CCPs and most gun owners that I know here in NC have one. The background check has already been done on these people. We also have a pistol purchase permit system for those that do not have a CCP stating that the background check has been done by their County Sheriff. These methods of proof are all that should be needed to purchase a legal firearm. States having some method of doing a pre purchase check and issuing a card or license should not require people to go through a dealer if the person already has been checked. If you are buying a gun from out of state you have no choice but to go through a dealer as this is law but for in state purchases, whether at a gun show or at a Food Lion parking lot, if the buyer has proof of residency and proof they were checked by the appropriate agency that all that should be required.
 
i don't think here in florida,ccp to ccp sale makes a difference,although that is a good idea and hope we have it that way.
i'm guessing it's gonna be more costly and a hassle to legally sell a gun ,even to a friend ,just the way the politicos want it.
 
Private sale of long guns within your state should not require the services of the FFL dealer. If they insist on paper work and background checks federal forms with the NICS phone number should be available at post offices. Private sellers can handle this themselves.
 
The new NYS law requires ALL private sales to go thru an FFL so that a NICS check is done.

We have had this for private sales at gunshows since 2000, though until very recently, it was largely ignored.
Then KingKomo's A/G (Schneiderman) set up some sting ops and arrested many doing private sales w/o NICS checks.
So the last year or so, it's been pretty much by the book with everyone looking over their shoulder wondering who the other guy really is. Kind of Police State like which is how they want it.

Now the new law (yesterday), ammends the old by demanding that ANY private sale of a firearm must be handled thru an FFL so that a NICS check be done.
There is one small loophole for transfers within 'immediate' family as I understand it. 'Immediate family' was not defined in that rough version of the bill as I recall.
That was in the bill as it was being pushed through,,but I don't know if it's in the final signed into law version.

There was for a time in NYS when your NYS P/P was proof of a background check and you could by-pass the NICS check when buying a firearm from an FFL.
The FBI decided that NYS & the County's that issued the permits didn't do a good enough job handling the background checks of P/P holders, updating info, ect,,and after a couple of years of that,,it went away.

The only thing that that extra background check did for you after that was being able to transfer a pistol from one individual to another (permit to permit) w/o getting a dealer involved to do the NICS check.
That's gone now too with the new law.

FBI will never extend the NICS system to private sellers. To do so would be to expand the number of FFL's in so many words. That's something Clinton diminished by Executive order in 2001(?) and something they would never allow to go back.
If anything the restrictions will be more cumbersome, European like. The same direction they are taking everything else.
They know what's best for you, they will take care of you and keep you safe. Trust us.


Don't forget it can happen anywhere,,see how quickly they can make laws when they really want to..literally over night..
