Gun shop owners sentenced to prison

Daves was a pretty good gunshop when Dave owned it. I went there for years. He sold to this pair of alpha hotels who thought their **** didn't stink and that the ATF was just harassing law abiding citizens trying to male an honest living. They couldn't (or didn't want to go through the hassel) get a FFL so he was using Dave's (Dave is a real nice guy who was a straight shooter). These two deserve every minute they got. You ought to have seen the face book postings of these two after the warning conference with the ATF. Like waving a red flag in front of a bull. I followed this case on Pacer and it was classic methodical police work and prosecution all the way. I do feel sorry for the many people and Dave, who will probably loose the guns on consignment and inventory not properly logged in. These two were and are trash.

I wonder is that the Store where about 30 years ago I bought this holster?
My Bro took me to a local Store that me liked and I found this holster in a stack of used ones.

It is sad that these "alpha hotels" can even use the title of "gun shop owner".
While accurate, the press is having a fun day using that description for these 2 very uncommon criminals.
 
I would not want to be a gun store owner today. I have been present on several occasions when a man and woman came in to look at handguns and it was painfully obvious who was going to end up with the gun after they walked out the store. Straw purchases are against the law and it is the owner's responsibility to nix any such sale but in today's climate, doing so would probably open you to all kinds of lawsuits unless the couple slipped up and acknowledged one was buying it for the other. And in defense of the FFL holder, they know that if they refuse to sell the gun to the couple, they will just go down the street to the next gun shop and buy it there. It's pretty darn rare to see someone jailed for a straw purchase.

On the other hand, dealers who are operating outside the law as well as non-dealers selling illegally, need to be treated harshly as in the case Caj posted about. I don't remember the exact circumstances but in Michigan, we had a guy convicted of illegally selling something like 100 guns and if I remember correctly, he was sentenced to 7 years. I think it should have only been 5 years - per gun - served consecutively.
 
I just hope the "system" doesn't let those bozos out early for "good behavior." They need to serve the whole term. Even better, he needs to be put in a cell with a 6'8", 350-pound goon they call "Big Suzy.":D

Federal time-they do 85%. They would buy guns "off the books" or take them in on consignment, not enter them on the books and then take them to gunshows and sell them as private citizens. They could have gotten nailed for a lot of tax evasion charges as well. Guys like this are why the ATF is so hot about gunshows
 
Federal sentences get 54 days a year good time after the first year. And these people are likely in a camp akin to Orange is the New Black. Two person cubicles inside a big open area . . .

There was a local shop doing the same. He'd take in guns, not log them in his bound book and sell them off the books. No tax. This knucklehead sold them out of his storefront. It didn't take too long for the Feds to catch him and he did a stretch in the can.
 
It is intriguing that the ATFE provided these "gun dealers" with a hearing/meeting to warn/inform them of their transgressions and outline the requirements for correct procedure. I was unaware the ATFE did that kind of thing anymore. That kind of courtesy seems reasonable but my local FFL, who is clean as the proverbial whistle, says it's an artifact of days gone by.

A former career police officer, my FFL really likes and respects his ATFE inspector. I've met her and she seems both reasonable and intelligent but she told my FFL a couple of years ago they adopted a zero tolerance rule and she has been specifically instructed to offer no leeway to anyone. He claims she can yank his license for typos. Thus it surprised me the ATFE met with these criminals and, apparently, gave them a chance to straighten out. Seems more than accommodating these days.

I checked out his Instagram account, 2 trips to Europe between 2015 and 2019. Nice of him to spend all that "extra" outside of the US.
 
We had one here doing the same.He had a reality show for awhile.So brazen! I think they got him for tax evasion too. Former leo
