Guy shoots himself in middle finger & butt holstering his semi-auto, cops seize all !

God, this pisses me off ! Guy I know a little came into the gunstore today. Shows me the blown off tip of his middle finger and tells me he had an AD. Apparently he was holstering his Kahr, I think, DAO semi-auto in his plastic holster and his t-shirt got fouled up and the gun went off. Blew the end of his finger off and then entered and exited his butt cheek. He knew his finger hurt bad but didn't realize he shot himself in the butt too until his wife said he was bleeding there also. They called 911 of course, and the ambulance and the Sheriff's Deputies show up. They seize all the guns on his permit, and then they seize all the guns on his wife's permit !!! No charges filed for anything, just an accident. Deputies say they are going to keep his and her guns for 30 days, because, now get this, to test them and see if they were ever used in any crimes !!! Are you freakin' kidding me ??? How illegal is that ??? Another bunch of crap and probably a good case for violation of rights. I told him he should at least contact the NRA or something. He was told the guns are safely stowed away in the safe. That's what they told me too when I got my guns back after 6 months and they brought them all out together in a large paper shopping bag !!! UGH ! What a farce. Is it just New York or is this crap going on elsewhere ??? Shoo

Yeah, it stinks bad. Guess the sad excuse the Sheriff's Department is using has something to do with the possibility of domestic violence, but that is totally unfounded as there's no history of that, nor does the wife's statement describe anything but an accident. I hope somehow this is brought to light so it won't happen again. They are coming for our guns fellas, Shoo
 
NYS, such a beautifull place-to bad state and local government is totally whacked out.
Another reason why I moved outta there.

That doesn't seem right. I have heard of police down here securing guns for eveybody's safety while sorting through a situation but never taking them without cause. Sure would think they'd need a warrant or something to start taking things.

Yup.. I was transferred to Rochester N.Y. in '83.. Did the right thing and called to find out what was involved in getting a permit.. Lo and Behold a Deputy showed up and confiscated alll my guns.. The wonderful Monroe County Sheriffs Dept also wanted to know how and why did I own them.. I told them the moving company did it

They told me that that was against the law.. but will let it go this time!!!

No matter they took the guns, nothing big mind you.. Colt Python.. Colt Diamondbck, Colt Combat Commander.. S&W Model 39 and 59.. All dumped in a "gym" bag..and stored in the "ALL SECURE" Police property room

It took 7 Months to get them back..
I loved living in Rochester.. but jumped at the chance of moving out...

It's probably not illegal at all. It sucks, but I'd be willing to bet that there is some sort of provision in the laws for CCW holders that they were using to seize the guns. For one, he did discharge a firearm somewhere other than on a range and it wasn't in self-defense. Two, he discharged a firearm negligently and there were injuries. The fact that he only injured himself doesn't really matter when it comes to the letter of the law.

It sucks, no doubt, but there has to be some legal basis for a seizure and from the sounds of it there could be several. If there wasn't a legal grounds for the seizure it means a nice, fat lawsuit for violating his/her 4th Amendment right against illegal searches and seizures. R,
 
Several years ago, one of my target shooting acquaintences somehow managed to shoot himself with a .45 ACP SWC round. Cops were called to the hospital to investigate the gunshot wound, and ended up confiscating his M1911 for several months. Did "ballistics testing", charged him over $100 for the testing, kept his pistol for several months, and after several requests to return it and a letter from his attorney, they did. Was it legal? Dunno, but that's what they did.
 
No matter what, state law cannot abridge civil rights. Have an attorney contact the LEOs and discuss 4th and 14th amenment rights and ask for a copy of any warrants.
 
Guys, we can all get pi$$ed, but that's what the state of our country has come to. To 'ensure the public safety' ( nice catch-all phrase, that, huh ?

I sympathize with the guys who live in NY and feel like it gets stomped on too much on the forum, but I have to say, New York, Taxachussetts, Kommiefornia, . . . I'm happy to just live in hillbilly land where (for the most part) those kinds of things take hold a lot later than in the rest of the country.
 
Let's start confiscating cars after any auto 'accident'.

Gotta check them out for thirty days because they could have been used in running moonshine.

BTW, thousand are killed and injured in auto accidents every year.

Truly sorry to hear of his injuries.

I sure am glad it wasn't a Glock or we would never hear the end of it.
 
I hear you, nope, not a Glock. It was a DAO with no manual safety. Probably one in a million odds that the t-shirt would get fouled up in the trigger guard area like that. Probably should have added that this happened to a veteran shooter with 40 years experience, Shoo
 
Hi Shoo.The "Kingdom of New York"is once again living up to its Anti-Gun mentality.Hate to say it but the AD may be all the grounds they need to pull his Pistol License for good.I can see taking the gun that discharged but not all his and hers also.I would have your friend get a lawyer and see if he can get them back.If it is a matter of him not having access to the guns on his license during thier investigation have a trusted FFL take possession of them for safekeeping and storage.They are private property that belong to him......God Bless Mike

P.S. The time my brother shot himself in the leg, we doctored it up ourselves, we were at least a hundred mile from anywhere of consequence.
Folks need to start thinking about lookin' after themselves...
