A talented, vicious lawyer will wring big money out of this failure to follow OSHA rules. The lawyer and the estate will both benefit. The emotional terror, complete helplessness, loyal dedicated employee following boss's instructions, the pain and agony during the cooking process, the list goes on . . . . .......
 
Unless they can prove an intentional or wantonly wreckless act, all this guy's family has available as a remedy is Workers Compensation. They may have a third party action against the manufacturer of the oven for not installing a fail safe inside in case someone gets caught like this poor guy did, but other than that he will get a standard death benefit IF HE HAD DEPENDENTS. If he is divorced and his kids grown, the estate won't get very much at all other than burial expenses and perhaps a nominal stipend. One of those tort reform thingys passed a few years back to protect the employers from the greedy frivolous lawsuits you know.....
 
When I first read about this, I was haunted by the images in my head for several days. The horror this man faced, as I'm sure he knew what was to happen, and the unimaginable agony he went through still bothers me.

And forgive me for saying so, but what has whether you eat tuna or not have to do with the horrific demise of this poor man?

That's like saying I'm giving up water because people drown in it.

I don't know of any state where the exclusive remedy is either a recent development or a result of tort reform...
 
Calling it in cost them 12,000 pounds of tuna and possible jail time...mames you wonder how many times they don't call it in and just say "Jose must have gone back to Mexico" and just let it slide.
 
Lock out, tag out is about as straightforward as it gets. Somebody must have forgotten something. Where was he when they were loading the six tons? There probably wasn't much extra room and noisy....... Stuff happens.

My sister is the safety nazi, err safety director for a major irrigation manufacturer in this state. You would not believe how often lock out, tag out rules are ignored, and trust me, my sister is no pushover. The fault lies with management failing to enforce consequences for not following the rules.
 
I don't eat it, my dad threw it out of his bomber in WWII as he hated it more than the Germans. He only said that tuna fish is nothing but expensive cat food.
