Obviously you guys come from more sensible states. This guy comes from Blumberg(sp) and Schumer territory.
What's going to happen is the guy will be convicted of the 'D' Felony and lose his gun rights completely. That is if he survives what the gang will do to his house and family.

Pete, I respectfully disagree regarding the felony conviction. Although I now live in gun-friendly Florida I'm originally from the Northeast, so I'm familiar with the anti-gun stance up there. However, I'm also an attorney and well aware of the power of the plea bargain. Assuming the DA even goes forward with criminal charges, Grier will likely have a good shot (pun intended) at a lesser charge such as disorderly conduct--which is what Ron Dixon got for shooting a guy with an unregistered handgun in NYC back in 2003.

Northeastern states like NY and NJ may be tough on guns, but they can be easy on crime in general and there's plenty of room to dicker. I wouldn't bet on Grier being convicted of a felony here, although reprisal from the gang is another story . . .
 
From what I read in the newpaper, he had not been physically injured and was not yet in deadly danger when he fired the shots. Nor, had he retreated to the interior of his house. That is what the law requires in NY. Thankfully, I don't have to live in that state.

He used poor judgement in firing warning shots. In a self defense situation, if you are going to fire a gun, then it should be for real. Warning shots are for hollywood.
 
I saw this on the local news this morning. I doubt very much he'll even be charged with a felony let alone convicted. NY is bad, no doubt, but juries(if it even gets that far, which I doubt) are somewhat sympathetic to people in his plight. No one was injured, and thank God this won't be made into a racial incident.
Maybe I need to move to a State where you can fire at will? :rolleyes:

Could not have happened in a worse place.
CA and NY are gun hating places.

No criminal Hx, and leagally owned the gun. (good)

maybe moving might be in order...
cuz you gotta sleep sometimes... and MS13 dont.
And moreover, they dont follow any rules...

Here's how the story goes on Orielly.

3 punks arguing amongst themselves in front of house. Homeowner tries to run them off outside. Then goes inside tells wife to call cops and he grabs AK. Cops say they got no call. Homeowner goes back outside with AK. Then threats start and more gang members show up. Homeowner fires off rounds as warning and he later claims he knows cops will show up quick when shots are fired.
 
While not anti-gun, O'reilly isn't exactly one of the most gun savvy commentators around and I loved it when Magyn (sp?) Kelly corrected him for describing the weapon used as an automatic rifle.

Too bad he talked over her as she went on to explain fully automatic weapons are not legal for Americans to own without a proper license. Or something along that line - like I said - He started talking before she could finish what she was trying to say. :mad:

Unfortunately, the reason she gave for the correction was to avoid the massive number of e-mails they get when they make incorrect statements about guns, but at least she did make an attempt to set the record straight, so to those among us that send those e-mails, keep it up - it's working!!!! :D

I believe they have the "shot sensor" in his area. According to the story anyway. Supposedly it detects any type of firearm discharge. Spooky, eh?
 
Acoustic sensors are placed around an area to direction find incident sounds. They are set up to differentiate between normal sounds and incident sounds. Using triangulation from multiple sensors, the location of the shot (within a few feet or yards) is identified.

Why were "three punks" aka gang members arguing in front of this particular house ? Did they live within a house or two of this house ? Or did this just look like a good house to get into an argument in front of ? Why this particular house ?
And as a HD weapon in a densely populated area, an AK clone is a poor choice ..... Did you notice that there were seven AK's in the news photo ? Why not just one ?
But there's certainly more to this story than has been reported >
 
Let me see if I get this right:

MS13 members for what ever reason congregate in front of this guys house.
He goes there and tells them to beat it.
So more MS13 come and start threatening him.
He goes inside and tells wife to call the police and takes out his AK clone and goes with it outside.
Police does not show up, because they have a huge work load since this is a *** of town to start with.
Frustrated and verbally insulted he fires the rifle into his front lawn.

Sorry, but if it went down like this, the guy would have been arrested even here in Maine.
1. If they did not enter his property, he has no business even asking them what they are doing.
2. Even if IMHO MS13 member should be shot on sight, it is not illegal to be a gang member.
3. Discharging a 7.62X39 in a urban area is a very dump idea.

Now the guy lost his gun and he will loose the right to have firearms.
He and his family will have to move, because the MS13 gang members will be back one day and at minimum beat the hell out of him.
